National Credit Corp

    These people contacted me via phone.. well I wasnt going to call them back but I was curious as to what they had to say.. anyhow.. I caled these guys. The woman on the phone said she was calling beacause I disputed their account on my credit reports..
    I was like ok .. She said asked me straight out "why would you do that".. I was thinking to myself um what business it of yours.. I didnt say anything though.. I sent a letter asking for proof. I told her I did this and would like something I signed to prove the debt was mine i.e a singed contract.. I was told I would have to contact this other place and PAY $20 .. I couldnt believe it. I have to pay for proof?!? I didnt say anything else but ok thanks.. and hung up..
    Does this sound like a load of b.s to anyone else besides me??

    Is this a CA? Are you not sure if the account is yours, or what the correct amount should be?

    If this is a CA, they can't charge you a fee for validation. It would be a violation of the FDCPA, section 808 I think. They are required by law to either validate the debt or stop collecting on it. I wouldn't talk to them on the phone again and wait the 30 days from when they got your letter. Then go from there.

    well it isnt a CA per say.. Its a finace company of sorts.. They do financing for Fitness USA.. Its been a couple of years but the debt is probably mine. I dont know how they got to that amount. Maybe I do in fact owe that but they wont send proof. It doesnt seem quite right they can charge you $20 for proof that the debt is yours..

    ok they called me back and changed their tune..
    They are sending me a copy of the contract..
    They got the dispute letter I sent them..
    I was told that letter didnt mean anything.. but they are going to send the contract anyhow..

    making a note to myself -- they are next on my list.

    BUT, National Credit Corp. is the OC right?, therefor you should be asking for verification and not validation? (Someone correct me if I'm wrong). Which if that's the case, I would ask to see

    #1. The signed contract.
    #2. A History of Original Amount Owed, All Payments Made, and any fees they've tacked on.

    yes thats correct that is what I did..
    I just have to figure out how to attack this..
    Someone please correct me if I am wrong but it is my legal right to dispute this debt with the CRA for whatever reason I wish.. Do they have the right to call me up and hassle me over why I disputed it?

    -NameIsJen, read the link below about validation v verificaiton. THEY ARE ONE IN THE SAME.

    -I wish I could have caught the perpitrator who started this rumor that they are seperate! :)

    -Yes, it is your right. BUT, it is also THEIR RIGHT to concider a dispute frivilous :)

    -Because this is not a validation issues, they do not have to cease communication.

    -HARRASMENT is NEVER their right :)

    Yes I understand frivilous ..
    I was just extremely irriatated that they called me and questioned me about why I filed the dispute with the CRA.
    I guess I should have known better than to take thier call..

    -COULD BE PRICELESS.

    -IF they were refering to the dispute letter being out of the validation period, then it is worthless in a complaint about a violation of FDCPA 809.

    -Also because it tells you their mindset if you have to go to court.

    I wont say they wont take me to court over this but its unlikely.. according to the CR the amount past due is $488..

    I am not even trying to get something to sue over.. although I would love to have something to levearge with.. The only thing I want is for it to be deleted from my credit report.

    My main goal in this credit war.. is to get out from under past mistakes and hopefully not do the same stupid thing again.

    To achieve #2 you may well have to accomplish #1.

    Don't matter wither it's a CA or if it's an OC they can't charge you for documents for something in dispute .
