Fascinating. A small businessman who accidentally violates and calls someones number can be fined $11,000 PER INCIDENT. But of course the multi-million dollar CRA's get fined UP TO $1,000 per action. This law places a severe, undue burden on telemarketers.
it is a bit slanted. Im guessing getting $11,000 is for obscene violations. the low $1,000.00 FCRA/FDCPA fines are probably an unspoken admission by the govt that CA's and CRA's are going to screw up more often than not.
Hey was watching Texas Justice the other day, and some guy sued a company over that. Actually, it was a 3rd party service that called, and then forwarded info to the guy being sued. The little guy won! I thought about all my fellow Cneters at the time, because the telemarketer came in with this nasty attitude, no documentation, made a smart-ass comment to the Judge, that cost him $4,000. Sound familiar? One more for the little guy!
