Can someone advise me, please? My sister is in a great depression at the moment. She received, in one day, a notice from the county that she did not pay her county taxes in 1998 and 1999, and (I can't remember for sure about this one), I think in 2000? I remember when our county "came down" on this a few years back and she ran into not being able to get her license plate renewal until paid. Therefore, I am pretty sure, but not positive, she paid this, but she cannot find proof. She has moved several times since. Can anyone help me with the statute of limitations for NC county taxes? I think there is one, but can't find any info on it. She also received a notice on the SAME day (today) that the IRS cannot find a 1998 tax return for her. She cannot remember if she ever mailed one in, being very slack at the time (she was younger and stupid). Can anyone suggest what she should do at this point? I sure could use some advice. Thanks a lot!!! If it helps, we went through several years of trauma with our mother being terminally ill. All of our memories are somewhat affected at this point.
get a consult from a tax lawyer. You want to pay/settle this before it gets on your reports. Otherwise its a long time of VERY bad credit. hard to get those tax things off. lawyers give free advice over the phone. No proof? Thats a bad one. You are required to keep all tax info for 5 years i think.
I agree that you should keep records, at least the forms, for some period of time. I keep mine for at least 7 years. I keep the backup for three years from filing date, then I ditch a lot of that because it's past audit period (unless they think they can prove fraud). But I don't know if there's an SOL for filing. I agree that you should consult a lawyer and see what you can do. Can she check her bank accounts? See if a check was written for the county taxes. Or if there was a mortgage that paid the taxes, they should have records. I don't remember how county taxes are paid in NC, it's been 20 years since I lived there. For the IRS, if she had to pay there should be a check. If she got a refund there should be a deposit that is out of the ordinary. I don't know if they did direct deposits in 1998 or not. If so, there would be an annotation that it was a tax refund. Getting documents from the bank may be expensive, but it's better than the alternative.
Thank you both for your answers. I got an e mail from her this a.m., and she just paid them with credit card rather than worry about it. I hope she'll save her records from now on, because I remember when this happened, and I am almost positive she paid them once before. As for her 1998 tax return, don't know what she'll do at this point.
I agree that you should keep records, at least the forms, for some period of time. I keep mine for at least 7 years. ========================= You don't want to toss anything even after 7 years. I learned that the hard way. Cost me 4800 bucks for ditching records after 7 years. Expensive lessons like this tend to get ones attention. fyi there is no SOL for filing, there is no SOL for penalties and interest. the SOL starts when you file, the feds will GET you eventually. The states' are generally retarded except a few. Been there done that. i got about 42K in fed+penalties paid off for $8K it wasn't e-z but the other offers from the irs was $500 month for 10 years (SOL on collecting once filed) which included interest. do the math... pay the irs, folks, pay now, or don't pay at all , have no assetts and hope they take your OIC
