    NCO just wonâ??t go away, I sent them a validation and cease and desist letter. They called me after they already received that letter. I have phone documents and a tracking number to prove this. They left intimidating messages on my machine and have not been able to validate a thing. After about the fourth letter to them, I wrote them back and said if they tried to collect any further I would report them to The Better Business Bureau and The Federal Trade Commission since they violated the cease and desist, which I have.

    They just sent me another letter three months later with just a signed contract not the original bill. If you look at case by case a signed contract means nothing. So do you guys think I should take them to Small Claims Court? Or just wait and see what The BBB dose with my complaint? Iâ??ve done this with other CAâ??S before and once you start mentioning The BBB and others they tend to back off, but NCO is being a pain in my neck. They are not in good standing with The BBB. Sorry for the length of this but I'm getting pissed!

    I have read in other threads that NCO backs off rather quickly when litigation starts. File an action in Small Claims Court. Trust--you'll thank me later.

    You requested validation, and they couldn't and didn't validate. You then sent them a C&D. They violated the C&D (hope you have copies of everything, and the green cards)

    Just sue them for vioating the C&D order. Sending you the "proof" you requested 3 months after being told to cease all collection activities is a clear violation. And I agree with boywonder, they'll likely cave when they get served with a suit.

    Just a thought.

    I'm getting to that point. I did file complaints with The BBB and The Federal Trade Commission. They do not have a good record with The BBB, a few cases are unresolved. I'll see if The BBB helps me out first, then I'll sue em if they don't.

    I had a problem with an OC, NCO kept sending letters and calling, but each time changing their internal account numbers, different amounts, etc.

    I told Emmons if it did not stop I would sue him personally, it didn't stop.

    Filed suit, they settled.

    I have 3 accounts with NCO. 2 from BofA checking accounts that were ACHed for monies after I directed them to stop. Overdraft and interest and penalities added up to about $300 for one and $100 for another. They also recently got one from a utility from my previous apartment. That utility continued billing for about 2-3 months after I left and refused to pay the amount....since I wasn't there.

    I am going to first clear up a CA account from the lease I broke first to get my feet wet before I go after the NCO pains...so it would be nice to hear a little about them so I am prepared when I go at them.

    They did the same thing to me. First it was their office in PA. This last one was from their office in NY.When it was in PA the first time their office in Enfield CT called me and they had the account. I sent the cease and desist letter to the PA office which is where the letter came from. A week after they received the letter the Enfield office called me They are playing games.

    I have heard that if NCO even thinks that someone will take legal action they will back off. Which is why I complained to The BBB just to make them look bad. I will try what you suggested though if I have to.

    My experience w/ NCO is they will make stupid mistakes while you request validation. Check your reports to see if they were listed as "disputed by consumer" while you were disputing; also, if they do send validation, its months after the 30 day period.

    I'm trying to figure out what to do as we speak!! NCO sent me copies and signed application today from CCB. I don't want to deal with NCO, but I'm not sure how to proceed.
