NCO....Grrrrrr!

    I sent NCO a validation letter back in September for a credit card bill they say I owe. Didn't hear anything. I checked Equifax today, and not only is the account not listed as "in dispute", but they are still tacking on interest.

    Isn't this continued collection activity? What next...estoppel followed by dispute with CRA's after I get the green card?

    Also, I have old addresses I want to get off EQ. I've read some people just call and get them deleted, but my report says I have to send a driver's license or utility bill. Does calling work for this?

    Anybody? Am I on the right track with this? I've read posts saying DON'T use estoppel, but send another validation letter....

    I know SOMEBODY knows the answer to this, even if you think it's stupid. (Yes, I've read the Hall of Fame posts, please humor me)

    To estoppel or not to estoppel?

    Just send another validation letter?

    Dispute with CRA, and and then tell NCO "gotcha!"?

    For me, I have always called an NCO rep, got a name/date etc.....waited for him/her to make a few violations.....

    Then I would send an ITS to NCO at the same time I would dispute on the CRA. It would get deleted from the CRA and I would never hear from NCO again! ;)

    I haven't heard a peep from NCO since I sent them about a half dozen validation > escalation letters since August... ;)

    August, I received the privacy policy only, no account numbers etc, so I sent an anal retentive everything including the kitchen sink validation for any and all accounts (then disputed the two Marlin Integrated tradelines on Eq - which were deleted (yes, they actually deleted)), in Sept, they 'supposedly' obtained a new account; however even that account was already under a VD request, so no matter how they tried to slice it they still violated... :)

    Last week I escalated it again by filing a complaint with the BBB against them for the two violations of the FDCPA, one violation of the FCRA (non-pp for pulling while the account was under a VD).

    Surprisingly, I was mailing to Marlin Integrated's main physical address from their BBB report in August, and after my mail campaign, lo and behold they had their physical address pulled from their BBB profile, and an "NCO FINANCIAL (MARLIN INTEGRATED)" entry put in its place... ;) So, I know that my mail campaign did have an impact on them... ;)

    I'm helping my sister w NCO right now, and I'm curious...exactly which address did you use? I never did check the BBB site, but I looked here at CN, NCO's site, and my sisters CR and they were all 3 different addresses. I went ahead and had her mail a Validation letter to the address on her CR, because that way she's 'covered' legally. It was a local (same state) address btw.

    Sounds to me like you have been very patient but NCO is simply taking full advantage of that fact. Short and sweet, if you have documented evidence that Marlin/NCO is in violation of the FDCPA or FCRA then it is time to stop side stepping the issue. File suit as that appears to be the only way to get their attention!

    I started with MICHC because that was the company name that was on the initial tradelines that I was going to dispute the minute I received their privacy notice.

    The 'supposed' new account is an assigned collections account with NCO.

    BTW: I am making my paper trail concrete, if I was anal retentive and sued at the first violation, I would have sued within 24 hours of their first contact... ;) but I didn't see that they had pulled a CR the day before that first contact, until about a week later... :) Three violations, or one, which sounds better to my wallet.... ;)
