NCO $$ Offer/ Capital One

    so far my experience with cap1 has been good but after reading the above, i don't think i will stay with them much longer...

    as for NCO, my experience is VERY BAD... if someone left you a message from NCO saying that they will show your account in positive status once you pay, I WOULDN'T trust them!!! i had ONE collection YEARS ago which NCO handled and they said once i paid they would send me something in writing and change my account to closed (favorably). this was before i educated myself in credit matters, but i took her word for it... because i was being hassled, i paid and asked for the letter upon receiving my payment (BIG MISTAKE, I KNOW!!!--but this was before i knew!!). they sent me a BULLS*** letter which basically said i paid but this cannot be used as proof until payment is received (what the HECK WAS THAT????!!!). they wouldn't deal with me after i got my money, and the only thing they put on my report was paid/collection (which is STILL the ONLY bad thing i have on my report TO THIS DAY!!!!!!)... I have tried to have it removed over and over but they are the bastards that stick!!!!

    good luck!!! i agree with billb, it is better to pay than not, but try to get them to send you something in writing!! and see if you can work with cap1 instead....

    I got NCO to delete just for the asking, but it was med debt. Maybe I caught them on a good day.

    From my personal experience with NCO, and I do have experience I sued and settled twice with them.

    The quickest and fastest way to handle them is to sue them for violating FDCPA and state laws, shouldn't be too hard to get them to violate they make a habit of it pretty well.

    Sue them and they won't be able to settle quick enough with you.

    Their attorney's know me very well!

    i think you must have... it's funny because i only ever owed a couple hundred bucks. not even enough for all this bother!

    The collection agency can and probably will delete their TL from credit reports (the only reason they post collection accounts to credit reports is for exactly this leverage) upon an agreed settlement, but they have little power to have the OC do the same thing.

    When we (Re CA) make the purchase or servicing transaction, we receive a power of attorney that gives us the inherit rights under the original cardholder agreement. We have the ability to "bind" the original creditor in certain situations. This gives us the right to settle an account and REQUIRE that the original creditor, such as Citibank, MBNA, Household etc. remove the original trade line and OURS.

    Someone was asking a while back about getting the oc to delete in addition to The CA.
    Don't know who the poster was or on what thread they posted but here is your answer!!

    it would post the next business day, and you would wind up with a late fee. Did it post a day or two after you sent it, or did it post several days after it was sent?
