I know this has been asked and answered before, but I have searched for an hour and cannot find a post that is answering exactly what I need answered. I have 4 medical collections that have been turned over to NCO Financial. They are reported on my CR as collections. I want to pay the original creditors for these accounts. I know if I pay the original creditors that I can then send NCO proof of payment and tell them to leave me alone. However, won't they still be able to report it as a "paid collection" on my CR? I want it completely removed from my CR and I don't know the legal way to get around that. In other words, I want it paid through the hospital and completely bypass the collection company (NCO Financial), but I don't want it to remain on my report as paid but still a negative. How to handle??
I would think the first step would be to contact the OC and tell them you are willing to pay up. Make it a stipulation that they yank the account from the CA. Look at it from their point of view: If they pull the account back they get the full debt settled and it goes into their accounts. If they leave it to collections, they only get a portion of the cash, the rest goes to the CA. Just don't expect any leeway if you default a second time though. The other alternative is that you can strike a deal with the CA and pay up a lot less - after all, they are simply there to make money, any money! The down side is they may sell the rest of the debt to another CA who will keep dogging you. Call the OC and ask them what they would be willing to settle for?
as apexcrsrv said.... 1) call NCO, verify who NCO is trying to collect the debt for, is there a JDB involved? verify the name and amount of the original debt. Inform NCO that you using a work phone and you are not allowed to receive collections calls at this number. repeat "The number I am calling you from xxx-xxx-xxxx is a work number and I am not allowed to receive collections calls or calls from NCO at this number. DO not call me at this number, this is a work number, I cam not allowed to receive these types of calls at this number. IF the original creditor is the owner of the debt: 2)Send NCO a request for validation and Cease & Desist. Sned by cert mail with return receipt. 2) About a week after receiving the green card back, call NCO and see if they are still pursuing collection of this debt. If NCO is no longer pursuing collection: 3) Pay the original creditor, include a form letter as shown by whychat Done. ps - google whychat and you will see the correct letter to send with payment in full.
First of all, don't call them. Do everything in writing. Secondly, it doesn't matter if it's a work phone or not. The correct wording is "it is inconvenient for me to receive calls at any time at any number. Please communicate only in writing."
NCO financial We are having problems with NCO too. My son is in college FT. He has all of his loans for his school thus far through Campus Door which was bought by Lehman Bros. (and we all know what happened to them) Anyway, they are calling at all hours of the day anywhere from 8am right up to 9pm at night, multiple times of the day and have been for months now. They've been told that he does not owe anything, that he's still in school - they continue to call. I've given them my son's cell #, yet they continue to call my house number. The last time I spoke to someone from NCO (after being so fed up with the phone ringing over and over again) I told the person I was speaking to for the millionth time that my son does not owe a thing, he is STILL in school. He said to me "yes he does and since you are a co-signer, if he does not pay, your credit rating is going to be ruined too". (I HAD an excellent credit rating too and when I checked it, sure enough it's on there that I am behind in payments due to this!!!!) I said to him "are you threatening me?" He said he was just "stating the facts". I hung up on him. They STILL continue to call. My son has contacted the company he has the loans through and they told him they were looking in to it (this was about 3 weeks ago) He's not heard back. This is nothing more than intimidation. Another thing, is it possible that there can be 2 collection agencies involved trying to collect on the same loans? My son said that another company has called, VanRU and said they were also calling about his college loans. How is that possible? The bottom line is though, he's still in school, he should not be in repayment. That shouldn't happen until he's out of school for 9 months. Any help, suggestions, contacts, etc would be GREATLY appreciated!!!! Colleen
Is that advice what you learned from Whychat? First send them a cease & desist so you leave them no other way to communicate with you except by filing a lawsuit against you? Secondly call NCO and see if they are still pursuing collection of the debt? HMMM! What number would you advise be called? They have several hundred you know and the chances of getting the right one is slim to none. You say that if NCO is no longer pursuing the debt then pay the original creditor? What should we do when the original creditor refuses to take the money and tells you to pay NCO? That's what their contract with NCO says they have to do. What then? You say to google for whychat and get the letter. I did that and found 79,700 links for that search term. Only 4 had anything to do with whychat. One of them went to some forum where Whychat had mistakenly told someone that the SOL in Florida is 4 years when the truth of the matter is that creditcards are considered to be written contracts in most states so the longer term is what is generally used in most courts. Apparently it was in the case mentioned on creditinfocenter too. Another of the 4 listings for whychat went to another message board that had so many messages you couldn't find what you were looking for and it didn't seem to me that the first two had any such letter as you were talking about. What is it that I don't understand here?
Problems w/ NCO too This would be the DOE Ombudsman in my state, NJ? Just tell them whats going on and they can actually help with all this craziness? I really hope this is the case and if so............thank you a million times!!!!! Colleen
I don't know all the details, but I do know that many have been helped by the DOE Ombudsman. I would certainly contact him if I were you!
