just got a credit bureau from equisux and got another collection deleted! but i looked and saw where a collection from NCO is reporting paid. I was paying on a medical bill (sending the checks directly to the hospital) and now it is showing a 0 balance. my question is how do i go about getting it deleted? I know i can send a letter, but how should i word it so i don't piss them off? thanks
If its paid, you can still ask them to validate. I recommend the nutcase series. Just modify it a bit so it isn't exactly like the template, as I'm sure they have seen the template many times. You can find the template in the 'sample letters' section of this site. I just managed to get NCO to remove two paid collections from my CRs. Sent them Nutcase1, Nutcase2 30 days later, then an follow up letter when they sent me a "we can't find your account" letter. 1-2-3...gone!
hey deacon, very interesting post... i had an electric bill from 4 years ago that was placed with nco... i paid the 188 dollars, but i needed to act quick (car loan)... just before i paid it, i disputed w/ tu, who responded lightening fast as 'verified' i sent d/v and got d/v... so i paid... it still hasn't showed up as paid w/ tu yet (but nco gave me a letter...can you believe that)... how long would you suggest that i wait before i fire out a nutcase series? i have yet to use this form of credit repair, and would sincerely appreciate your feedback. thanks so much.
hey kbean, i've got a utility bill i found out i had (moved out of town) that got turned over to a collection agency, i paid it in dec 2002 and it came back verified by the cra as unpaid as of may 2003. i don't know which letter to send to them also
the first nutcase letter sends a copy of a drivers license and a photocopy of a phone ill or electric bill. i thought it was a no-no to send that info
I can only relay my experiences with using the nutcase series. First up, I'm sorry...I thought the nutcase letters were in the sample letters section of this site. You can either do a search for 'nutcase' to find them, or you can go here (click the 'form letters' link). Duke and kbean...you both seem to have interesting situations: paid collections that don't show up as 'paid' on your CRs. Technically that makes the tradelines on your reports wrong, and you could ask the CRAs to verify (and maybe delete) based on that info. What I'd do is stick with the nutcase series though, and try to knock out those tradelines by dealing directly with the CA (in this case, NCO). Send them Nutcase #1, and see what they respond with. If they respond with anything less than a signed contract (by you) to validate, send them nutcase2. It might help to check out the 'what is validation' sticky link as well to understand exactly what they are supposed to send you back. To both of you (kbean and duke), I'd send the letters ASAP. And to Duke, I wouldn't mail CAs any extra info (drivers license/bill). I reserve giving a DL copy to the CRAs the very first time I mail them, but thats it...CAs get nothing extra If you give the CA your name, account number, and SSN, they should be able to find the necessary information. Oh...mail those USPS CMRRR (certified mail return receipt requested...the green cards). Good luck!!
thank you, but as i mentioned, it was an electric bill, no signed contract is available... i just paid and can't dispute on that basis as it does take 90 days for an update to take place...
Even if you didn't actually sign anything, it doesn't really matter. Nor does waiting 90 days until the 'paid' notation actually shows up on your report. You paid it with the CA, so dispute it with the CA. If they can't prove its yours somehow, they have to delete it. Check out the 'what is validation' link to see exactly what they are supposed to send you. Also, if you disputed with TU, and they responded that it was 'verified', then send them a procedural request letter. Let them tell you exactly how it was verified. If you want, you could wait until the 30 day period is up after you send nutcase I to the CA. Either the CA will give you full validation (not likely), or they will give you partial validation, stall, or not respond at all. If they do any of those, you can mail what they sent to the CRA with your procedural request, and say something like "how did you get the CA to validate if they didn't even respond to me?!?". again, i thank you for your response...however, as i mentioned, i have received full validation from nco... i am familiar with the fdcpa and brennen vs. spears in terms of validation...they met my request...so i plan on waiting for them to forget about me for a while...that was the nature of my question... a recommendation of how long to wait... but i thank you. i have paid the collection acount as of last week... also, i have been doing this for a while (only new to this board...) so i don't want to be labled as friv. but i may try the pr request when the dispute is finished...
