I have perfect payment history for over 8 years now and NCO pulls a hard inquiry. Can they do this? I'm very concerned where this could lead after their recent headlines. I have no derogitory marks on any of my credit reports and now TU shows an inquiry from NCO Group colllection services on 5/10. I did have two chargeoffs over 8 years ago but they were never turned over to NCO. I've worked too hard for too long to let these criminals start f*&#ing with me. Do I have any recourse?

I undserstand they can still try to collect, that the debt cannot be legally reported on my credit reports and that SOL is up, but how often can they pull hard inquiries on me? I have a lot of searching to do on the board regarding pp, but if NCO has nothing more than a bill (i.e. nothing signed by me) than do they have pp?

There is no provision on how often a company can pull your credit report. Just whether or not they can pull a credit report. I would send them a combination non-pp/validation. Make it your own just tell them that you've never heard from them, they pulled a copy of your credit file, they haven't yet provided you with a notice of your rights, but you are fully invoking all of your rights. You want to emphasize that you are treating their inquiry of XX/XX/XXXX as their first communication to you, and they have not provided you with your notice of rights within five days of that initial communication.

Repeated pulls of a debt beyond SOL would look less like "attempting to collect a debt" and more like "harassment" and posting negative information beyond the 7 years allowed, particularly if the CA had been sent a "C&D" notice on an out of SOL debt. The repeated collection inquiries would have little legitimate debt collection use other than to broadcast negative information to creditors.

If they've been given the "jump in the frozen tundra and never contact me again" PERM C&D, then it would be an illegal communication, but that still doesn't mean that they didn't have a PP, just means that even with the PP, they're breaking another law...
