Hello all, I've been out of the game for a while now. Ive managed to get my credit looking pretty good. Just today I decided to pull Experian and noticed that NCO put a baddie on my report on an apparent medical bill from back in 2002 for a whopping $223. I never received any letters from NCO at all or I would have paid it, or atleast sent them a validation letter what I will probably do is. get a fax# for them and send them a copy of my small claims court form and give them 72 hours to remove. I'm confused. On what grounds are you prepared to sue them? On the fact that they put you on a CRA but never notified you? I don't know that there is any case law demonstrating that that is a violation. If you choose to go that route, you will need to be extremely well prepared. Most small claims court judges aren't too versed on the consumer law. I'm not sure what success you would have. I'm assuming that this is still within the SOL. Unless you are prepared to pay this, you may be opening a can of worms. You might see if they'll delete for payment (in writing of course). I believe that if it were really illegal to post on a CR while not notifying the debtor, the CA's could be bankrupted in a hurry. I personally had 2 bogus ones that were on mine for years without any notification. I think they do that all the time. Not that that's right, mind you, but I'm not yet convinced that it's against the law.
This is one of the reasons why I was inquiring on when the first reported date was. If the first reported date was this or last month, the first letter could still be pending. First step would be to send a strongly worded letter demanding validation of the alleged account, and emphasize that they have never contacted you to provide you with your rights under law, however you are invoking all of your rights under the law. The minute that you know that they should have received the dispute, demand verification through the CRA's. Butch provided a really simple one which works wonders, especially because in this case the company hasn't contacted you, so you can't recognize the trade line in question. I appreciate everyones feedback on this. When I pulled my experian report yesterday here is what it listed- Date opened: 08/2003 Reported Since: 03/2002 Date of Status: 03/2002 Last Reported: 12/2003 This is completely BS because I've pulled my Ex report during all of the dates listed above and this account was never listed on my report during that time. This account was just recently listed. And I do have copies of my reports during that time to back me up. Rich C, I completely understand where you are coming from. And to be honest, I'm just shooting from the hip with NCO. Over the past 2 years I had worked non stop to get my Cr's looking good and have spent over $3k fixing my ignorance from the past. If NCO would have atleast contacted me about this $223 the chaces are very likely that they would have got paid because my clean CR's are like gold to me. But instead they want to report this on Experian of all Cra's and I would rather smash my pinkie finger with a hammer rather than deal with Experian again. I do have the TL in dispute and I'll see what happens. But I fully expect experian to be the same old experian and verify the account as accurate. When that happens I'm sure that I could pull up enough case law to sue them both. Because all of those reporting dates that I listed above are all bogus and I have copies of old credit reports during that time without that TL listed as backup.
mrmat: It may have been reported, but suppressed for some reason. Demand the validation, first, and dispute it with the CRA's, hopefully it takes them more than the 30 days to get the validation, and the entry gets deleted.
