How can Capital One be so stupid. I sent my last letter and lawsuit giving them 72 hours to respond. Its been thirty days and they have pretty much ignored my previous two Intent to Sue Letters w/paper trail of tampered credit reports and have deliberately in the dispute process (verified incorrect data) destroyed my charge off tradeline with two CRAs (one is a R5 and the other one is a R9). Because of this I got hurt on the interest rate for my new home purchase and questions were raised during an employment credit check. They re-aged one tradeline from 5/98, 7/98, 4/2002, and now 10/2003. They have change the rating on another one from a R5 (negotiated with Mr. Cook a year ago. Account aged gracefully with a FICO score of 683) to a R9 (FICO score 703 as of 10/2003) back to a R5 (FICO score 660) with a reporting date of 12/2003, which really killed my score. I don't know what they are thinking. Are they daring me? I have two cards and a car with their organization and they are treating me like dirt. My lawsuit is laid out with a paper trail of tampering. It is very professional. Had it done at Kinkos. I hope this will get their attention. If not, I will have to take them to court and send copies to the FTC, Attorney General, and the BBB. I can't believe they are so stupid. Do they think they can win?

Possibly because you have sent 3 ITS's now and have not sued. If I had all the proof and a papertrail after the first ITS they would have recived a summons and complaint from my local courthouse. Just some food for thought don't threaten without backing it up.

Thanks George. My first two letters were informal and I wanted to give them at least 30 days, and I needed quick results because of my employment situation and house purchase. The damage is already done on my house purchase. I did get the job. My third lawsuit is very formal and says "this is my final letter". It is very well done with exhibits. I believe they will take this one seriously. I have been trying to give them a chance to rectify because I have two credit cards and they are my oldest tradelines. I also have a car loan with them. At this point, I don't really care anymore, the damage is already done. I will need to refinance next year once my scores recover. Thanks for the input.

Also, the final letter has my lawsuit attached. This wasn't attached to my previous two letters.
