Hi Everyone, After disputing an old collection account with Midland credit (Montgomery Wards) I received a wonderful response. The Midland credit tradeline disappeared and in its place was an RMA tradeline with a fresh new account number and reaged by one year. Bellow is Midland Credit Management MONTGOMER- 98113XXXX INDIVIDUAL ACCOUNT 09/1996 10/1996 Open 120+ DAYS PAST DUE $572 $855 $855 01/20 Prior Paying History 30 days past due 00 times; 60 days past due 00 times; 90 + days past due 01 times; CONSUMER DISPUTES THIS ACCOUNT INFORMATION COLLECTION ACCOUNT RMAPP NOAUG SRS RMS005 MONTGOMER-1248* INDIVIDUAL ACCOUNT 12/1997 120+ DAYS PAST DUE $866 $866 $866 03/20 Prior Paying History CUSTOMER UNABLE TO LOCATE CONSUMER COLLECTION ACCOUNT Believe it or not, these are actually the same accounts. Now the Midland is gone and the RMA is in it's place WTF?? So if anyone has a good contact from equifax, I would love to have it so I could email them first before I take this any further. Thanks, Sal
Why contact Equifax? Your beef is now with RMA. Believe it or not, you're making progress. Most likely, Midland couldn't validate and pawned the account off on RMA (which in and of itself may be a violation by Midland - ie. continued collection activity.) As with most things, there are branches in the path ahead of you with no absolute right one (although there are absolute wrongs.) Instead, the path you depends on what you want, ie. $$$ or quickest deletion... Someone, Lizardking?, specifically developed a validation letter for secondary CA's which basically tells them they've been conned by their bottom-feeding brethern and to go suck an egg ;-) Or, check your state consumer protection laws. Some require a CA to notify consumer within 30 days of debt assignment. When, if, you hear from RMA or decide to initiate something, send them a standard validation and wait for them to start making violations you can use to get deletions. 0
The letter was authored by Butch, and can be found in the sample letter forum under "subsequent CA strategy".
