need a sample letter

    I need a sample letter. Can anyone help?
    I need one regarding accounts that were IIB that still show charge offs with charge off dates AFTER the BK7 discharge. I disputed as IIB and they came back verified as charge offs. My attorney said they could report charge off, but had to also include the BK. How can the charge off dates be after the BK? Do I send letter to creditor? What do I say?

    To Whom it May Concern:(Creditor)

    I recently received copies of my credit reports from all three credit reporting agencies (CRAs). The account I had with you was included in my Chapter 7 bankruptcy. I disputed with the CRAs my former account with you to accurately show â??Included in Bankruptcyâ?. You have refused to update my account to show this accurate information. In addition, you have incorrectly reported the charge off date as 3/2004 on my Experian report. This date is a year after my discharge. You cannot list a charge off date AFTER my discharge since that would be false, deceptive, and misleading information.

    I understand that a bankruptcy discharge will not erase pre bankruptcy payment history. I am not questioning your right to report the history of the account. I am questioning how the account is being reported after the discharge. I am entitled to an accurate history which would include your history on the account as well as it being included in the bankruptcy and with a zero balance. After the discharge, I am entitled under federal law to have the balance of each discharged debt reported as zero.

    Please let me know how and when you plan to update my account

    From my experience with my own bk and credit repair, any accounts included in bk should only state "included in bankruptcy, discharged through bk ch.7". They cannot charge it off after it has been discharged through bankruptcy. It should be stated as I said "included in bankruptcy...". That is how you should go about your dispute. However, I would dispute as not mine first, since you don't have that account charged off! You might get lucky and have it removed entirely. If anyone has a different experience, I would like to hear it.

    If you have documentation that the items were included in the BK, could you not send copies to the CRA?
