I found a item on all 3 of my girlfriends reports from Asset Acceptance. I would like to have it removed so I am going to the steps I found on this board. 1) Send validation request to them, this is the address that they have on the equifax report. <Asset Acceptance, 7027 Miller Dr, Warren MI 48092> 2) Wait 30 days and send estoppel letter. 3) Whats supposed to come next? That is if they can't validate. Small claims court? btw, I am sending it usps ( postal service) piority mail with signature confirmation, that is form 153. that way I can check online who signed for it and request a copy of the signature also. It's problably gonna cost around $5 , but at least they can't deny me the signature.
After you've created your paper trail (i.e., validation ltr, estoppel ltr, even an intent to sue ltr) I would suggest you then take all your proof, make copies of letters, signature confirmations, etc, and send to the CRA's asking them to delete. You may get lucky and they'll accept your proof, or, if they do decide to verify with the CA, they SHOULD hold them to a higher standard of proof then "oh yeah we have Joe Doe in our computers...", and if the CA can't truly verify to the CRA, the CRA should then delete the account. In the meantime, after you have confirmation that the CA has signed for your validation ltr, you should pull your gf's report and see if they noted the account as being "in dispute". I'm not sure how long they have to note the account as being in dispute after they receive your request for validation, so I suggest you pull it a few days after you received confirmation they received the validation ltr, and again a day or two before the 30 day timeframe is up. (This can be easily done with Experian, if you're using creditexpert and equifax with creditwatch) If they did not note the account as being in dispute, that is a violation, one you could use as leverage against them in your last ltr (intent to sue).
