I have two unpaid charge-off accounts on all three of my Credit reports. In August of 2001, I received a letter from RMA attempting to collect the debts on behalf of the Origanal Creditor. On September 5, 2001 I sent letters, certified return receipt requested, to both RMA and the Original Creditor disputing the debt and asked for some verification that the debt was mine. As of November I had not heard from either of them so I sent a second letter demanding verification. It's been a year and I still have had no response. On September 6, 2002 the Original Creditor pulled a hard inquiry without my permission. Through this entire process the accounts have never been noted as being disputed by consumer. I want to bring suit against the Original Creditor in Federal Court for violating my rights under the Fair Credit Reporting Act for failure to note the accounts during their monthly updates to the trade lines. As well as during the multiple disputes I initiated through the three Credit Reporting Agencies. I could file suit myself in Justice Court, but the monetary damages alone are much more then the $5000 limit. Frankly, I want to give as go as I got and I think a Corparation with a Market Cap of over $80,000,000,000 can afford to make things right. I have proof of actual damages, not just in credit denials, but also monetary damages for a Vehicle I financed and the Mortgage for the home I bought this past year. Both of which I did not get favorable rates for due the the unpaid charge off's. Am I out of line here, or do I have a chance to get paid?
You are so in the line, the line must look like an airport runway for a Boeing 777. Read the FAQ for tips on court. Send demand letters to pay you $XXX for the violations they have racked up as well as a demand to remove any and all information they listed with any CRA. Send to BOTH OC and CA (different violations of course). Since you have given them the extra 11 months to verify I would demand they do this immediately or you will see them in court.
