If my mother sends a c&d letter to collection agencies, will this get these items deleted from her reports and leave it up to the original creditors? I have a feeling these could all be truly and legally validated, even though there's some fraudulent actions in the large debt (ie: is it TRULY owed and the false date) The situations at hand are: CA #1: 2 debts 1) $657, 12/1998 2) $2724, 2/1998 *should be 9/1995, jerks!* CA#2: $36, 12/1996
A cease and desist letter requires collectors to stop contacting you. It will not get the items deleted from your Mom's credit reports. The collection agency has a couple of options upon receiving a C&D letter 1) depending on the amount they may stop trying to collect on the debt 2) they could take your Mom to court for nonpayment 3) they could sell it to another collection agency. I would dispute the information with the bureaus or send a validation to the collection agencies. I believe they have 30 days to respond.
