need help big time.

    Our mortgage guy just called. He said the credit looked great except only on equifax- there is a judgement from 3/00 from our foreclosured house. The judgement is listed as unpaid and not satisfied although it actually has been. Even if it is listed as paid he said it has to be 3 years since the judgement on a foreclosure so my question us- how can I possibly get this dismissed or vacated. I do not know what rules apply and if the old mortgage company or the lawyers who represented them can have them do it. I could nail them on FCRA violations for refusing(and they refused to do anything about it yesterday) to list it as paid and satisfied. They have already been paid in full. Our house is picked out but obviously if I cannot get this settled fast we are all done here. Help help.

    I also need to know- we disputed the judgement and it came back verified. The UDF they sent me has the lawyer/ca for the mortgage company that representing them saying it was not satisfied and I have it in writing. If I show the CRA proof that the judgement was verified with incorrect data can I force them to delete it totally from the credit report or would they just be forced to update it correctly.

    If you send them documents, they will update it correctly, and you will never ever get it removed.

    Does anyone know of any way to get it removed. My mortgage hangs on this one thing on one CRAs report

    There are programs out there that will ignore the foreclosure if you can show that it was paid and is over 2 years old. Your rates will be higher, but at least you will be able to get your mortgage. In your situation, it will probably be easier to go nonconforming, however, you may be able to still go conventional.

    Yep that was what I was afraid of. I can get 6.75% now if I removed that one judgement just from equifax. It is worth it to wait 7 months than get something that is a couple percent higher as that would add thousands to the mortgage and we do not have much for a downpayment. I am gonna try and threaten equifax and call the courts to see what I can do.

    Does anyone have a sample letter they used to try and vacate a judgement. IT cost $30 to give it a try so I may as well try it.
