If a consumer has proof that a bank is using deceptive banking procedures to increase nsf charges who does that consumer contact in the state of new york.Had a balance in my checking account of 230.00 withdrew 220.00 from atm.The bank took out a 37.00 nsf charge first which left a balance of 193.00 then subtracted 223.00 (220.00 + 3.00 atm charge) leaving me with a negative balance of -30.00.This seems illegal to me.Since this is the only banking transaction i made.
Did you have any pre-authorized withdrawals in the woodworks? They might have hit your account before you went to the ATM.
Banks are bad. Lately I have noticed that they make you wait forever and place holds on deposited checks (sometimes up to ten days or 2 weeks) but they sure can deduct an amount ASAP from your bank account! The other thing I have found is say you have 1K IN YOUR ACCOUNT, several checks come in one for $975 and the other 2 for $20 and $10. Well they will BOUNCE ALL THREE CHECKS< charge you for THREE CHECKS to the tune of BoA $37.50 EACH! This happened to a friend recently, and I called the bank saying I was my friend and asking WHY they wouldn't have paid at least the small amount checks and she said they do the large check first. I said then how come the large check bounced and the bank said because all THREE caused an overdraft. Something should be done about these banks! CLASS ACTION ME THINKS!!!
You need to talk to the bank first. If there is a branch nearby, go there and speak with someone (not a teller, but one of the CSRs that all banks have). My husband did this and they explained to him what happened. But they also refunded the NSF fees as a courtesy. If it's a national bank, the oversight authority is the Office of the Comptroller of the Currency (www.occ.treas.gov). If it's a state bank, it would be regulated by some state agency.
