I have a creditor that has been reporting an false bankruptcy on my creditor profile. The bankruptcy showed as follows on two (2) different reports from Experian: Status: included in bankruptcy/past due 180 days Account History: 180 days 8/1995 to 12/1996 150 days as of 7/1995 120 days as of 6/1995 90 days as of 5/1995, 4/1995 60 days as of 12/1994 to 3/1995 30 days as of 11/1994, 8/1994, 6/1994, 5/1994 Discharged Through BK Ch 7, 11, or 12 01/30/1997 to 01/31/2000 This account is scheduled to continue on record until 11/2001 on another updated Experian report it shows Status: included in bankruptcy Account History Discharged Through BK Ch 7, 11, or 12 09/01/2001 to 12/31/2001 This account is scheduled to continue on record until 1/2004 As stated above, this is a false bankruptcy which I am disputing with the credit bureau. I am in the process of preparing a letter to the creditor directly disputing this inaccurate information. If not removed immediately either through disputing with credit bureau and directly with creditor, I plan to sue for violation and punitive damages. My questions are: 1. Is this how bankruptcy notations normally appear on a credit profile? 2. Do creditors normally "periodically update" bankruptcy notations as indicated in my reports "Discharged Thru BK 01/30/1997-01/31/2000 and updated in my most recent report "Discharged Thru BK 09/01/2001 to 12/31/2001? I basically want to prove that the creditor is doing this out of malice. Any advice would be most appreciated. Thanks, my2sentz
1. No. It's not. For a Ch7 It just should say Included in Bankruptcy. Those late annotations usually drop off 2. I did have a creditor keep updating the date until I did a disputed it with the CRA and it stopped. (I filed Ch7).
