Hi, My credit is being threaten by Superpages.com for a bill I never received. I have been out of business and disabled and found out I have progressive disease. I was under medication and in pain. I took the call on Feb 07 from a sales person talking about upgrading my free listing from 12 years ago. I told them no. I wasn't in business anymore. They continued to talk and I really don't remember much what was said and hung up the phone. They claim because I gave authorization over the phone it is legal and I don't remember but I surely would have not done it in a 12 month contract. That much I know. It is now in collections and the collection agency is making fun/rude of me as they don't believe me that I not in business. I told them the address that what Superpages used was 12 years old and there is no way that I would give them that address. I told them they got it off the Internet from the free listing. The collections agency said that it wasn't free 12 years ago. I have paperwork that shows I was disabled in 12 years ago and the old address that proves what I have told both of them is the truth. I can also get a doctor statement to help me stated I was under his care and medication, if needed. Superpages sent out paperwork to the 12 year old address and of course, it came back. I received one call about needing new address but I couldn't make out the phone number on voicemail. Why would any run an ad on a business that doesn't exist? Why place a business that doesn't exist on the Internet? Something isn't right with them. They had a email address and could have email me anytime about billing but they didn't. Does authorization over the phone give them all the rights? What about when a person is medicated and doesn't understand. I just wanted them off the phone. They have done this before to other people. They had two class action suits against them. Do you know if this goes against my "supposedly" business credit or my personal credit? Can they report this collection to the credit bureaus with a 12 year old address and my phone number. I just check the phone book it is not listed and will call phone company tomorrow to see if they can give out my address with name and phone number. I want to thank you for all you help. You helped me in the past build my credit. I am now 9 years from paying off my home. And my credit score is 781. I like to keep it that way. Thank you. Bunni
Well, first it's a business credit issue ... which means that all FDCPA issues are off the table (except for that one oddball Mississippi case law that says calling at home can convert a business credit issue to an FDCPA issue). Second, if you hadn't been in business for 12 years, your 1040s will reflect that ... were you incorporated way back when? Without your signature on anything, it may be tough for them to get anywhere in court, but I bet they will try to put this on your credit if they think they can. I'm more concerned with the harassment level ... without the FDCPA they could call at all hours of the day and night, etc. This might be a good time to get a TV consumer reporter involved.
I thought this was a business credit issue but I was not sure. I just wondered if they would try to place it on my personal credit. No, I was not incorporated but the can check all the 1040s and find that out that I haven't file anything because there is nothing to file. I have no paperwork, terms, bills, nothing from this company but saying I say okay over the phone. The CA was wanting my fax number and told him I didn't have one. He was being rude saying how could I run a business without one. I said that is because I don't have a business. He just didn't believe me. I have papers I am sending show SSDI without SSN and the old address from 1996. Also from Superpages site where they offer free listings, I printed that out because he said that was not true either. They are suppose to send me what they have from Superpages to my P.O. Box. So far they only called twice. How do I go about getting a TV consumer reporter? Received bill from ARSI about this Hi, I finally got a bill from American Recovery Service. It says I can dispute this in writing withing 30 day. Of course, I am dispute the validity of this bill. They don't have an address on me or the correct spelling of my name. What paperwork should I require them to send me? I still don't have the terms, conditions or anything about the so-called ad that Idearc Media Verizon aka Superpages.com. How do I know ARSI have legal rights to collect this debt? I just want to get as much information about this as I can. I have never had to dispute a bill without ever receiving one from the original creditor. Thank you for your help. Bunni
You need to write a letter requesting validation of this debt from American Recovery Service. Explicitly demand evidence of a LEGAL contract. My bet is they will not be able to. Make sure this letter is sent Certified Mail Return Receipt Requested for your protection. The only evidence they could furnish is a recording of the sales call, if they did not inform you of recording the call, then they cannot use it as "evidence". Also clearly state that you are ill ("not of sound mind & body") in your letter; this will add substance to your claim, if this should go to court. Another key detail here not mentioned; is the "ad" or "listing" for Superpages there? Did they send a copy of the listing/ad? Most copy has to be approved before listing. This should be very easy research on the internet. Short story here, if they did not provide the product or service, the there is no "contract", they have defaulted on their own "perceived" contract. Lastly, inform them you are prepared to pursue legal action if this matter is not resolved fully, and add the words "time is of the essence". Let us know how it goes for you. Good Luck...
