need help in filing a motion

    Hi everyone. I have been trying to find a way to get a judgement vacated or dismissed and i think i found one.
    The judgement amount filed is not the same amount that the judge ordered. The judge order interest accrued on 474.50 & costs of the action ($320.50), but the credit reports & the paper showing the final tally from the court includes the 474.50 (total judgement of 795) . That is not what the court order says. The 474.50 was payed prior to court. So Can I file a motion to vacate/dismiss the judgement based on this inaccuracy. The full amount has been paid. Do you think it will work?

    If I understand you correctly then I have to say that I don't think so. It would have to be an error committed or allowed to stand by the court.

    The paper i am refering to is what the attorney for the OC filed when he filed saying the judgement was satisfied. The court cleark just filed it, it was never compared to the other papers in the filing. It just makes the judgement look twice as big as it actually is...

    In order to figure out whether or not a judgment is null and void upon it's face and therefore voidable one must look at and analyze all the papers in the file. It is the only way.
