hi, the lawfirm send me a ltter to garnish my wages. they did file the judgemnt on october 2001. it was account from citi bank. I did send a certified validation to citibank and they never id reply my mail . I also did validate letter to the Attys office who did fill the judgement against me. they did validate the debt, just saying i do have to pay 2900 . the acct from citi i didnt pay them since 1996. And in my state SOL is 6 years , and 6 years will be over this month. The law firm send me a garnish letter to my old employe and I dont work for that compnay anymore. 1) what should I do? 2) should i send them another letter to sue them. please help. thanks in advance
the SOL to sue you would be over this your, they sued you last year. They are correct. Think you need to check on the statute of limitations on the judgment. this Oct it will be a year.

First, Citibank does not fall under the FDCPA, therefore, they do not need to respond to your validation. As far as the garnishment goes, if they don't know where you work, they will serve you with either a subpoena or an order for supplemental proceedings, directing you to appear before the court. At that time they will ask you where you work, and you will have to answer. If I were in this situation, with a judgment already against me, I think I would contact the lawyer and ask what can be worked out as far as payments go. You can try the validation again, and they (lawyer) since he is a debt collector, will have to validate and cease collections until he does. However, if he can properly validate, you are right back in the same position.
thanks again, should i send them another letter. what will happen, if i dont provide them with the right work places name. the same company did a judegemnt agian me back in 1996 fo another acct, i wasnt even there at that city at that time. then this year after finding this borad , i did dispute with the CRA and it did fall off. at that time same thing happen, they couldnt garnish my wages. because i cam eto another city with a diff job. but i do live in the same state. citi bank total credit limit was 600 and i paid that amount to the law compnay who is suing me. so what should I do ? thanks
Did the Lawfirm send you the notice CRR or regular mail? I tend to agree with Kiyi, how much longer do they have to collect on the judgment? If it is only a month or so, maybe you could avoid answering them for that long, just a thought. Tuit
The judgment, if I understand this situation correctly, will be 1 year old in Oct. Most judgments are valid for a much longer period than 1 year. Yes, he needs to check on the state laws re:jdugments, but I'll bet the sol is much closer to 5 years than 1.
Are you saying the Citibank account will hit the SOL in a month? LHK, Will the judgement re-start the clock for the SOL? 1 more post till I hit 100!
I'm not saying that. He has a judgment against regarding citibank. The sol would have expired in a month, but they filed suit and got a judgment. Now that judgment will be valid for however long his state law says.
thanks for all the note, no, i did receive the normal mail, no certified email. accroding to my state SOL is 6 years and this 6 years will be over on june 26th. but the lawfirm file judgement agains me last october, i guess in theire letter they send me yesterday. noted that they send a garnishment letter to ex work place, which i worked there 3 years ago. they send me couple pages that i have to sign and send back to them. and a questionary that i have to fill, like how much i make per week, child supoort, blah blah... thanks akm

Do not ignore it. If you do, it will eventually catch up with you. I really suggest that you get ahold of an attorney to see if anything can be done to help you out. It won't go away by ignoring it. You have a judgment against you and they will do whatever they can to collect. If you can't afford an atty, call legal aid or most cities have something called "Lawyer Referral Service" where you can get a 1/2 hour consult for like $25. You really need to speak with an attorney.
thanks for the help lkh, i did speak with a lawyer, lat year when i got the judgement. that stupid lawyer told me to do a bankrupt , which will be cheaper and other wise it will cost me 1000 buck. i can pay 1000 buck to that law firm and have the debt settle. because they are suing me for 2990 soem dollar. thanks
Ahoseen, I'm not being rude, so don't take it as such. LKH and others have respectfully answered your question. The fact that you spoke with the attorney last year about a possible settlement and now, 7 months later you want to settle is a problem in and of itself. Again - you can attempt to call the attorney and try to settle for $1k or so, but I or anyone else can't say if they will take it. No one here can guesstimate how much money you'll have after a garnishment or how much they will take per paycheck. Lastly, even though they sent the notice to your old employer, if you work and some company is paying taxes on you, you can be found. And that judgement will sit there and sit there. And you will not be able to do much of anything with it there. The SOL on judgements is normally 10 years but the creditor can renew it for another 10 at that time. If you believe you were not properly served and want to attempt to delay action - do so at your own risk. If you have 1000 to pay them, try to work something out. Shucking and jiving by not telling them where you work or not showing up to the hearings will not help you. Believe me - they can and will find you.
thanks sweet and all other member for helping me out on this. after I receive the judgement letter, i did call that law firm and made a payment arraangement with them for $80 a month. After 6 months they called me and said that I do have to pay more money per month. How much did i get from the tax refund and all these question. and at that time i didnt know about this board and i was stupid. I didnt know what to do. thanks akm
