Need help on Violation

    They send me two files one with the wrong date of birth & one with the right one. Then I called them & they really screwed my report up. Now I have wrong date of birth, two tl of the same one good & one with 12 time 120 day late. What section of the FCRA would a split file will fall in?

    OK, Butch back in Oct, Eq sent me two files. File A which will call mine & file B for other. File A & B had same name different date of birth. File B had ever-thing I disputed deleted but had wrong birth date.

    So I called & they said OK will send U out a new report. I get the report back & they really screwed up
    still wrong date of birth, Tl that was close & in good standings now reads 12 time 120 late "impossible ".

    I don't think a ITS will work I want to go to sue & in the process can get my Bk deleted.

    So file A now has wrong DofB one tl line that was close in 96 read 12 time 120 dates late & other tl that was in good standing read 2, times 30, 2 times 60, 1 times 90. This was all good before file B came.

    Voilation I have.

    § 611 (A)
    § 607 (b)

    621
    (2)(A) In the event of a knowing violation, which constitutes a pattern or practice of violations of this title, the Commission may commence a civil action to recover a civil penalty in a district court of the United States against any person that violates this title. In such action, such person shall be liable for a civil penalty of not more than $2,500 per violation.

    Butch can u think of anything else?

    You have either a split file or a mis-merge problem.

    Have you tried calling their "special handling" dept.?
    I think this is one of those situations which require a long chat with them.

    Do you recognize all the TL's on BOTH reports, or is there a bunch of stuff on one report that doesn't appear to belong to you?

    They said they have fixed it but the lates are still there but I have not been late. I have called them & they said that is what is being reported. I have disputed this couple times. They will not up date or investigate anymore.

    In fact if there are, my guess would be it's on the report where the DOB is wrong.
