Need Help please!!

    hi,

    I am new to this board. I had an account with citi bank and was charged off 1994. After that there is a
    collection company name Messarli and Kramer was calling me all the time at my home and work last year. Then I was start making payment with them for $40.00 a month for 6 month. Then I stop making payment and they served me and I did receive a letter from the 4th judicial court in Minnesota. Then I called them again and start making payment for $80.00. for another 6months. Now thet are calling me again and wants more payment. My citi bank was only for $1000 . Now they are asking for $4300.00.

    please do advise, what should I do to get rid off them from my back.

    Why after 7 years would you start paying? That reset the statute of limitations clock and they can enforce the lawsuit or judgment if they have one. When you send the validation, make sure to let them know you also demand a full accounting of all charges and fees. Once you send the validation, they must cease actively collecting on this until such time as they do prove it throught the validation.     hi,

    they were keep calling me and saying that they will garnish my wages. I have a judegement showing on my credit report. That is why I did start making payment to them. Now they called me on firday saying that if I dont start making more payment they will garnish wages.

    Well, I suggest you go talk to an atty first thing on Monday. If you can't afford one, call the local legal aid or lawyer referral. They can usually get you an appointment with an atty at a greatly reduced rate. If that still doesn't work, the only thing I can suggest is to send the validation immediately. Make them prove the amount.

    Also, how much was the amount listed in the original lawsuit? I doubt it was $4300 at that time, and $1000 plus interest for 5 or 6 years, still will not come to $4300.

    You could always threaten them that they can either accept what you have been paying, or, if they issue a garnishment, you will file bk and they will get nada.
