Need Help Right Now

    Some of you may remember me posting about the older couple and their bankruptcy drama. We are refinancing their home. They have a home loan already to go, but Chrysler Credit is reporting is chargeoff account with a balance due, when it was dismissed in Chapter 7.

    We called all day today and they would not let us speak to someone, we have to fax a dispute in to thier dispute department, they made sure to tell me they had 30 days to investigate. They do not qualify for the loan with this chargeoff showing, we need this corrected right now.

    Can someone please help me with a very strongly worded letter I can fax to get this fixed soon, like as in the next week?

    Any help would be so appreciate. Thank you.

    Could you fax the discharge papers (with all other info blacked out) to the CRA? I know that with my house, info that was already paid, etc., all I had to do was provide documentation to my loan officer and she took care of the rest. Are you the loan officer?

    I don't know if the nutcase would be appropriate in this situation since it was not a paid chargeoff but dismissed in Bankruptcy. Board can you offer some insight? Also, if you don't mind sharing what is the address or fax number for the dispute department?

    The discharge papers do not list the debts. Her attorney from then wants $500 to copy the papers for her with the list of debts, she cannot afford it.

    These are just some older people I know who I was trying to help get out of a terrible situation, it is critical that this be taken care of by the end of the week.

    I will post that fax number in a little while, as soon as I dig it out of the mess of papers on the desk here.

    Can't you go down to the bk court and pull the file and have copies of the debt list made?

    BK court is about 4 1/2 hours from here, by the time we spent all day doing that, we could have accomplished something with Chrysler.

    Then call the bk court and ask if they could mail or fax a copy of it. It doesn't appear if you need this done now, that you have a whole lot of options.

    THAT attorney, this is the same one from the previous thread yes?

    Where's picantel? He needs a beating!

    It is all kinds of illegal to continue to collect and report in that manner but your problem is getting the information and quickly.

    Grrrrrrrrrrr, that attorney makes me mad!

    Anyway, when I needed copies of my papers, attorney would have given them to me but I was "archived" LOL, I love being archived. He said, the swiftest was to call and get them from the court, seems like about $5 total!

    The other thing is a pacer registration (online), that is free, .07 CENTS (read that attorney) per page and it has a listing of those included. I have pacer and would be happy to retrieve for you, but it takes their personal information to be able to do it.

    If you had time, I would send CRRR saying the debt was discharged and they are illegally reporting it incorrectly in violation of the US BK Code, FCRA, and state laws. Make them prove it WASN'T included! They received notice from the court, so they are being butts.

    I like the fax suggestion, the court for me was always bending over backwards helpful and they do a lot of their paperwork by fax -- that may be the fastest.

    Yes, same attorney who screwed them on the other deal. We called the BK court and they were already gone for the day, but she was told they would be able to fax her them in the morning. We are going to try that and if that doesn't work I am working up a blistering letter for Chrysler. Thanks as always sassy, you are really great. Are you sure you wouldn't mind getting them of Pacer if need be? I will pay you for the copies and your trouble if we cannot get them in the morning. Sam

    I'm positive I wouldn't mind, iamsamiam, as long as you don't mind giving me their personal information. I wasn't sure if you would be comfortable with that or not.

    It is so good of you to help this couple, they've been through enough!
