Equifax is listing my six student loans twice (so looks like I have 12). All six are listed under who I initially got the loans from (Mellon Bank). They are all listed paid/never late. I got these loans in the late 80's/early 90's. Since then, I think they have been sold 4-5 times. The latest owner (PHEAA) is also reporting all six with two 60 day lates. I disputed these in March. They are still listed as "under investigation". When I called Equifax, they told me that their "reasonable amount of time" for investigating is not up yet. I want to send a letter Tuesday demanding deletion. Anyone have any ideas on exactly what I should say or things to quote when I write? Thanks!! G
Geez, they consider 3 months and counting to be a "reasonable amount of time?". I would write a letter stating that you disputed these items back in March and that you would like to know what a "reasonable amount of time actually is." I wouldn't call either and speak to a Cust. Service Rep. Go higher. There are tons of e-mail address on the board for people higher up the chain. Someone said on this board... Never take a no from someone who isn't authorized to give you a yes. Don't take a no from one of the people on the front lines...
I completly agree with you rblues! (LOL) My experience has been that the first line cust. svc. rep. always gave me some kind of bogus explaination and when I disagreed they'd but me on hold to "get more (bogus) info" and it went no where! I don't even think the listen to you when you talk... they just pick one or two words out of your explaination/complaint and give you the generic response. If you do call (but I would do it in writing CRRR to one of those people previously listed here somewhere) speak to a supervisor. My experience has always been bad when calling though. Tell them their 30 days are up...etc.
All you need to know from the fcra is right here: § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i] (a) Reinvestigations of disputed information. (1) Reinvestigation required. (A) In general. If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer. (B) Extension of period to reinvestigate. Except as provided in subparagraph (C), the 30-day period described in subparagraph (A) may be extended for not more than 15 additional days if the consumer reporting agency receives information from the consumer during that 30-day period that is relevant to the reinvestigation. (C) Limitations on extension of period to reinvestigate. Subparagraph (B) shall not apply to any reinvestigation in which, during the 30-day period described in subparagraph (A), the information that is the subject of the reinvestigation is found to be inaccurate or incomplete or the consumer reporting agency determines that the information cannot be verified.
