DH had an account with a CA on just his TU report. It was for a local utility company that we are using and have been using for the last 15 years. The CA showed a debt from 1999. We disputed it and it came back verified with a higher balance. DH called the utility company to inquire as to why they have the account with a CA and why it was verified. The nice lady he spoke with, knew nothing about it and said that the account was current and there was absolutely nothing owed from 1999. DH asked for a letter and she said she would send one & she did. Well, we sent a copy of the letter to TU and asked for removal and of course they said they couldn't accept the info & would investigate. Well, within the last 2 weeks the CA has since added this account to my his EQ & EXP reports. What letter should I send to them to demand removal. Also, aren't they in violation of the FCRA since what they are actually reporting is inaccurate? They added a statement to EQ & EXP that the account is in dispute but it still shouldn't be there at all. Any suggestions on what letter to send them? We did not ask for validation on this account we just disputed with the CRA and then sent a copy of the letter from OC to CRA. Thanks paw67
Unfortunatly, I don't know if the CRA's can do much with the letter from the utility company as far as the CA tradeline goes. Since the letter didn't come right from the CA the CRA's will probably ignore it. That said, I had a similar situation. I had a mobil credit card that I settled on. It was listed on my tradeline as "Paid in full for less than full balance". A year or two after I setteled on the card a CA popped up and started trying to collect on that account. They put a TL on all of my credit reports. In speaking with the CA (Calvalry Investments) they said that if I could prove I paid the original account then they would go away. Since I didn't have anything from when I originally settled the account I wound up faxing them a copy of the Mobil TL from my credit report and circling where it said "Paid in full for less than full balance". A bit to my surprise the guy said "OK... we'll close your account here and delete our information from your credit reports". I asked for a fax to that effect and 30 minutes later I was holding it in my hand. I faxed that to the CRA's and they immediately deleted the CA's tradeline. In other words, I would take that letter you have from the utility company and fax it to the CA. Hopefully they will realize their mistake and fix the problem. Good luck, Brett
