Hello everyone and happy new year. I sent out a debt validation package to a collection agency and all they sent me back were some old bills and a letter stating they received my letter disputing the accuracy they determine the debt to be valid. This is not validation to me and I want to know does anyone have a letter stating that the information that was sent is not validation? Or should I just send them a cease and decist letter?

What exactly did they send you? Did it actually come from the OC via the CA? Did it confirm the amount claimed? How do you see it as defective?

If the bills were from the OC and forwarded to the CA, it's proper validation per most authority.

I was sent the original bills attached with the letter from the collection agency. But I owe the OC don't I, not the collection agency?

That is consider proper validation under most interpretations of the FDCPA. Yes, you do owe the original creditor but, the account has been referred to a third party. Really, who you owe is not relevant as to proper validation in this context.

Short of a violation of the FDCPA or your state laws by the CA, I would next be concerned if they CA was preparing for litigation. Perhaps an offer of settlement may be in order.

Is the OC a CC or similar type, or a mom and pop type business?

I agree with all the above posters that this package appears to be full and proper validation. In fact, per the requirements of the FDCPA, this is beyond the true legal requirement.

Is there a detail that we've missed? Is there an amount or date in question here? What is the basis for your dispute of this debt? Are you saying it's not yours? That the amount is wrong? Please detail if we've missed something.
