These guys are jerks. They made me an offer to settle, but I wanted a full deltetion and mailed a letter saying that. They called me and said they would sell my account to reage it before they would delte it. Anyone have anyspecial numbers or contacts for them? I am sending validation today. I had succes with them on an old telephone account for 179.00 I sent validation request, then estoppell. After the estopell they called and said they would delete. Threaten to sue them.
You might want to look at the Texas UCC. I believe the SOL is 4 years in TX. If you are over, it might give you some leverage. Also, you might try an accord and satisfaction letter with a conditional endorsement. Texas is one of the states that does not allow the endorser to use the "without prejudice" clause. I'd almost bank on the fact that they'd cash the check w/o even looking at the accord and satisfaction. Send it CRRR, get it notorized and sit back and wait for the check to clear. If they cash it, and you stated that it must be for deletion in the letter, you have them beyond any doubt. It worked for me on a TX collector.
