Need help with JcPenney/Bankruptcy

    Jcpenney is showing as included in my bankruptcy on my credit reports.
    Here's the problem. I have not used the card since 1997, it was closed by me, and had a zero balance.

    so it was a positive tradeline that is now showing as a negative tradeline verified in 2003. the account would have fallen off the 7 year radar next year.

    JcPenney is telling me that this is the law and they can get in trouble if they don't report the acct in BK. I asked how they knew I did BK and they said they have lawyers checking into this.

    I am bummed because a positive tradeline was changed into a negative one.

    should I care or let it go?

    I'm lost. Was the card included in BK? Or was it at a zero balance, and NOT included in BK?

    I am sorry.

    the card was not included in the BK because it was paid off in 1997 and I closed it in 1997. I did not include it in the bk which was just a few months ago.
    I was never late and paid the card off.

    it was a paid goodstanding closed account. now it shows as in the BK and verified 1/03.

    hope that makes more sense.

    Well, they are reporting inaccurate information, as it was NOT included in BK. I would try some more letter writing arguing with JC Penneys. If you dispute with the CRA you have more risk that they delete the TL. Since you are filing BK, all the good TL's you can get will surely help.

    You might quote part of Sec. 623 of the FCRA in your letter, "Duties of Furnishers of Information"...

    That is wrong for them; if you did not include in BK then they should have just left the tradeline alone. I was in a similar predicament and my lawyer told me that as long as the acct has a zero balance and not used then I do not have to include in bk, in essence they are not a creditor to me because I owe them nothing. Check with Planetfeedback to JCPenney and top Management can help you out.

    Just a thought, did you check your listing of creditors to make sure it wasn't accidentally added in some how? Just seems odd to me that they would have the bk info if they weren't notified.

    I called and talked with Jcpenney and they found out about my BK by checking records. they were not notified by me. I did not even remember having an account with them. they said that they have to close all accounts of people with BK....law or something.....and that they got in trouble for doing it.

    I tried to argue with the lady that she was wrong but she just kept cutting me off. I was not going to get anywhere with her.

    Fax JCP corp. office with a "I'm dead serious and ready to sue" letter. They will have someone call you in a few days. They take it quite seriously. Not like your typical customer service people. They will probably have someone from "GE Consumer" call (or at least that is how it showed up on my caller id. Fax number is below.
