I need to know whether or not the SOL in Texas restarts if a payment is made? I had a 6k debt that I was VERY behind on, and I was talked into making a minimum payment of 150.00 (actually two 75.00 payments withdrawn from my account) and they would mark my account as current. If I had known then what I know now I would have never made that payment. This payment didn't even make a dent in what I was actually behind in payments. Does the amount of payment make a difference? This was the only payment I made because they were real jerks and basically screwed me over. If the SOL did restart I am screwed, if not I just have to hold the CA'a off with validation letters for another 14 months. Validaion has worked so far, but I don't want my luck to run out. I'm scewed aren't I?
Typically this will restart the SOL. Texas SOL is 4 yrs, a payment restarts the clock to the date the payment was made. Texas state credit laws do require that a CA collecting in Texas provide you with a form for which to dispute and provide you assistance in completing the form if you request it. Make sure you include a request for the form in your validation and ask for help filing it out. If they refuse to supply you the dispute form, or help you fill it out then you have them on a violation of state law, as well as any FDCPA, or FCRA violations.
