I had sent a validation letter to NCO Financial systems which they rec'd 6/4 (got green card back). In the meantime I have been monitoring equifax credit report. When I rec'd green card back I disputed with Equifax and TU. On June 10th there was an update in the system that NCO verified an address and amount for this debt. Then on June 17th I pulled another report and noticed that NCO was not showing, I continued to pull reports for the next couple of days, NCO still not showing. I pulled antoher report today and low and behold there it is, back on the report updated. Now I have not rec'd validation from them yet, the 30 days is up on 7/4. I'm building a paper trial. Need some help with what violations I have them on. By the way the verified with TU as well. The only thing that is concerning me is that Equifax will not send me any reports on any of my disputes, they keep telling me I need to provide proof of my current resisdence, but I did sent them two of the things they asked for, but they told me that was not acceptable. I sent them a copy of my SS card and a notarized letter of authorization which is one of the things they had on there as proof. they told me I need to give them an electric bill or something like that, but I can't because I live with a family member. I also check my score. On Friday it was 535 today it is 582?? any help would be greatly appreciated. kathy
Kathy, You have your violation, You stated that it wasn't showing on your credit report for a period of time, THEN they re-added it during the validation period? that is considered continued Collection activity. Also, They can validate all year, but if your account is not in dispute on your Credit reports during that period of validation, that is another violation. My next question is, how much is this debt for?
Kiyi, Well, the one for NCO is for $XXXX then the two for Medclr (aka NCO), is for $XXXX and XXXXX. totaling around 675.00.All these were put in dispute after I rec'd the green cards. I also noticed that when it was put in dispute, they neither marked the accounts that why, even now, they still have not told the CRA that these are in dispute and turned around and verified information with them, while in the validation process. As soon as I seen that Equifax verified the information with them and took off the "consumer dispute Notation" I turned around immediately and disputed them again online. kathy
Kathy, The NCO needs to tell the Credit reporting agencies to place the account in dispute. Don't keep disputing them, next thing I would do is after all the investigation that you initiated are completed. I would head to your court house and file a suit against NCO for violations of the FDCPA and FCRA for the $3000 dollars.
Oh and edit your post above to total amount you owe, Not exact amounts so NCO spies can't check their records
Kiyi, Thank you I did edit the above. Was'nt thinking Does it matter that I re-disputed them again even when the first 30 days was not up yet. I definately jumped the gun when I seen it, I know I should of waited but I got impatient. do you think by re-disputing them that,that could hurt me somehow kathy
No cause after the redispute, it will come back either deleted or verified. Next you print out reports on all CRAs that have NCO listed and go to the court house and file a lawsuit against NCO etc. Just state the violations of FCRA and FDCPA, don't need to say what statutes til you go into small claims court. I would give the amounts of $2500. You will find them more then eager to delete.
