This is the situation. My husband has a student loan with Direct Loans. After receiving the loan, which was paid directly to the college, my husband only attended the college one and a half semesters. I had to have knee surgery, and would need him home to help for over a month. He dropped his courses, for many reasons, other than me. Anyhow, we get a bill from Direct loans for over $6000! My husband contacts Direct Loans to let them know that he had only gone to the University one and one half semesters, the amount was not correct. They adjusted the amount to $3500. Still not right. Again my husband contacted them, he was told we will check into it. In the mean time we kept getting notices, and nasty letters. Husband contacts them again, explains why he had to stop classes, my surgery etc. They put him on a forbearance plan, reducing payments. Fine but they still had not resolved the matter. I received a copy of his credit report, and noticed that the Direct loans people had reported to the CRA several lates 90 days plus. They never resolved the amount due! Husband contacted again, and they added to credit report- paid as agreed, payments never late. Except the old tradelines still exists! I sent a validation letter, later I found out they are exempt From the FDCPA. But just this week I have received three letters from them.
One stated a balance of $3961.00, the other $6,072.86. The other letter stated they were exempt
from FDCPA," however they had enclosed a copy of your signed Promissory Note that obligates you to repay your loan". There was NO promissory note! They just stated that they report derogatory remarks once accounts becomes 60 days late etc. They still have not resolved the matter. We feel the University was over paid and should reimburse Direct Loans. Any suggestions? I'm getting ready to send a letter in response to Direct Loans Many letters. Also, the balance on the credit report is $2251.00. There are so many different amounts!
