I had an acct with the gas company that was discharged in my 1999 BK7. I noticed that I have a collection agency trying to collect on this acct. They have it listed as acct opened in 2003. I need to know how I should proceed I dont want to send a validation letter since there is nothing to validate. This is a clear violation and I want to nail them. How should I proceed. Thanks

Ok send VL and then how do I follow up with the violation. Do I need to wait until they dont validate?
Not validating is not a violation of anything...if they don't validate, they cannot continue collection efforts....if they do it is $1000 in your pocket! You can always hit them later on with a letter stating that they can be held in contempt of the BK Court for trying to collect on an account IIB!
