I have a Capital One credit card account that I fell behind on...their Hardship Department put me on a three month payment plan where I would pay $41 per month, which would equal out to one full payment of $123. The guy who set it up told me that as long as I let them set up automatic payments the account would not charge off. After the third payment was made, I get a call from a lady who claims to be in the Hardship Department telling me the account charged off and payment is now due in FULL, however, she is willing to work with me to make payments but for me to be advised that the account is being charged 19% interest per day. I told her about the three month payment plan I was put on and that I was told the account would not charge off and I was not aware that it had. She said she would look into it and call me back. Several days later, she called me back and said her manager said it was charged off because the payments I was making "weren't sufficient enough". Does anyone know if I have any rights with this?? I think they should have to overturn the charge off since I was in a payment plan that their rep arranged. Any advice would be helpful. Thank You.
