    Ok, here's the deal.
I have an entry on all 3 reports that state a 90 day late. I have requested validation through the CRAs and the OC listed. All that ever comes back is "verified".

I contacted the OC 3 times in writing, with CRRs, demanding that they show me the account belongs to me along with payment histories, dates due and dates paid. I get the green cards back, but any type of response is not worth anything as far as proof. They actually wrote back once and said, "...we believe we are reporting the information correctly..." They didn't send any copies of statements, signatures, or payment histories.

So, this leads me to taking them to court. I want to get as much as I can out of these yodels, but I also don't know what type of suit to file. I checked out the LosAngeles County Superior Court site, and they also mentioned that for small claims, I can't do more than two per calendar year and neither can be more than $2500 each, nor one cannot exceed $5000. I do need to be able to file suit against another creditor later, so I have to keep that option open.

Has anyone filed in LA County that can offer some advice on what type to file and the approximate costs?

    Thanks.

I'd maybe try defamation, if you are sure that either a) you weren't late, or b) you're sure that the creditor won't be able to prove that you were. You also have to make sure you were actually defamed (applied for credit or job and turned down).
