Where to begin? What to do? Do I write the OC or CA at the same time I'm disputing with the bureaus? How many is too many to dispute with the bureaus at a time? If I can't validate with the OC or CA, but the bureau "verifies" then obviously I have grounds to sue for FDCPA and FCRA violations. I get that part. Also, what to do about collection inquiries and student loans? I have the following baddies, let's just take Equifax because everyone pulls it here. There's multiple lates within, this is just current status. American General 120+ days past due Bank North unpaid charge-off Dell 120+ days past due Sallie Mae 120+ days past due Sallie Mae 120+ days past due Toyota unpaid charge-off U.S. Dept. of Ed 120+ days past due Capital One unpaid charge off Capital One unpaid charge off Cross Country Bank unpaid charge off MBNA unpaid charge off MBNA unpaid charge off First USA 120+ days past due Household 120+ days past due Target unpaid charge off Sterling 120+ days past due Chevron 120+ days past due Collection Accounts Wolpoff and Abramson $916 Calvary Investments $2317 Superior Asset Management $332 Paid Collection: Unique Management Services, paid $28 (all that was ever owed, damn library fines, didn't get notice) but it says original balance was $113. Any ideas? it's from 1999. Equifax hard collection inquiries: Toyota and First USA I also have duplicate judgments reporting from 1998. Exact case numbers and everything. One says satisfied, the other says unpaid. I need major help. Or maybe I should just say f---- it and do a BK.
Re: Re: Need MAJOR help! It's getting old seeing this statement over and over plastered all round the forum. The thing I detest about it is it gives the reader the false impression all is lost and nothing can be done about their issue. If you can't advise the poster of their alternatives then please don't make the statement and dash folks hopes with it.
I don't understand how this is getting old. There are many, many concepts that are repeated again and again because this is a forum. If it were just a non-interactive web page each concept would be listed once. The beauty of this forum is that each individual can get help that applies to them in addition to reading about other situations that are similar and applying to help their situation. Please allow me to re-state what I was intending to get across, since I was alarmed when I read the OP: The lack of validation from a OC is not a violation that can be sued. Nobody has EVER dashed my hopes here and my intentions are purely altruistic. It is never my intention to dash hopes. (smile) Please accept my sincere apologies if I have offended. Written communication is limited in that body language is not involved, so sometimes the sensitivity with which something is being stated doesn't come through. I appreciate the invitation to provide alternatives. Personally I'm not an expert and try very hard not to state beyond what I (think I) know. To limit posters only to suggesting alternatives and not a one-liner pointing out something they should further investigate would leave many of us with nothing to say. LOL Also, sometimes I say something short to bump without stating "bump" (not on this post).
Re: Re: Need MAJOR help! lb, who are you to make statements like that? You go around posting your stupid new member link on every post and never explain why you do it.
Here's one super easy place to start. I've been behind on Sallie Mae student loan myself and ALL my TL now show 100% current with them, which is a HUGE blessing. So go to this web site www.salliemae.com and logon or create your logon account. Click on the Postpone Payments Button. This will take you to the forms to apply for DEFERMENT. All you have to do on the form is check a box that declare you are having a financial hardship. You can get 1 year with no payments at all, and in my case they back dated the no payment to my first missed payment and covered the whole thing with a blanket of "grace" --forgiveness. You can renew this deferment if things aren't better in one year. I do believe you can defer up to 5 years, and if you consolidate several loans you get a fresh 5 years. I hope this helps. This is a great start because even if you do choose BK then this student loan will survive the BK anyway. I've gone that route and would advise BK only as a very last resort.
