I had a Capital One credit card over 7 years ago. The SOL runs out in June of this year. All of a sudden some other collection company named JEFFERSON buys the debt from Capital One and post it on my credit report, then under the Capital One it says that the debt was bought off by the company JEFFERSON. Capital One charged this off 7 years ago. Like I said it was due to drop off in June. Is this legal? I thought only the credit orginator could post this to your credit. Please advise, thank you very much.
The CA can put it on your report, but it should still drop off 7 years from the date it went delinquent.
WHat does the date of first delinquency say on the new tradeline. If it is saying hte same as the OC then that is legal.. I would send them off the DV letter wait for the green card back and then dispute with the cr's. If the last date was June of 02 then you can dispute as obsolete and it will come off.This 7 year thing is different from SOL . If however this JDB has changed the date *re aged* as they are known to do then you will be able to get them if you want to fight this . If not get yourself a consumer attorney and he will know what to do. A JDB will more than likely remove a trade line if facing a suit. WOofer
Woofer, they did change the date, the put the date of March 2009. the original date is JUNE 2002. Thanks for the replies.
Are you confusing SOL with the 7 year time on credit reports? Or is SOL 7 years in your state.? Some states are much less. IF SOL in your state is seven years, I would not do anything until after the SOL as why wake a sleeping monster? If the date of March 2009 is on there this could be the date they got the account and that is fine. HOWEVER there should also be a date of June 2002 on there for Date of Major First Delinquency. You probably could get them both off now as obsolete as I have done this in the past where a tl was to come off say in June and in Feb. I have disputed and gotten it removed. Woofer
