OK, I have requested validation from collection attorney and also collection agency. Got 2 green cards back and waiting on the third one to arrive in the mail as well, which should be any day now. Well, I get a message on answering machine from CA attorney, telling me that creidtor will accept 200 more than what I offered as settlement and to call them. I think they can't validate and they are offering this and hope I will accept. What do you guys think??
I think that is a violation of the FDCPA and you should ignore it. Wait the 30 days and send your estoppel as well as an intent to sue for their willful violations. And, don't talk to them on the phone.
Court date? I think you need to give a little more detail. 1. CC or other bill? 2. Is the SOL up? What state are you from? 3. BRING THE TAPE WITH YOU and countersue for $1K
Thanks....but courtdate is about 10 days away..... I do not intend to have any verbal converstations at all.......PAPER TRAIL!!!
I did a George, looks like that makes me Superwoman. I answered the question before it was asked!!! hehe
Collection account tradeline does NOT say it is being disputed. I just checked it. Oh yeah, lets rack up the violations!!!
1. Credit card...$1190 listed on summons...CA lists $1590 on cr. Attorney wants 2100. 2. No, SOL is 6 years here and is at 4 year mark I think. 3. Tape, green cards, fax transmit confirms, letters all going to court
You sent validation and received the green cards, the Collection Attorney called and said they would accept $200 more than you offered? When did you make an offer to settle? -- something's missing.
