Need some help with collection

    Hey all,
    A couple of years age I joined a health club and signed up for my monthly fee to be electonicaly withdrawn from my account. I signed a two year contract (stupid I know, but I saved about $10 a month) and after one year I stopped going. I was still paying though because I signed the contract and I had an obligation. Well sometime in there my bank asked if I wanted to upgrade my card. I said yes, and it changed the account number so they couldn't withdraw funds any more.
    Anyway, in Feb I was contacted by a collection agency saying i owed this money and how was I going to pay it yada yada yada. They didn't have my correct address, so I hadn't received anything in the mail and I told the rep that I wasn't going to pay anything till I get something in the mail. She told me that the only way she could send me something was if I made a payment on the account. Otherwise it went straight to legal. I told her I wasn't going to do anything until I received something in the mail. A week later she called again. I told her that I hadn't changed my position, and she told me she had no other choice but to send it to "Legal". I didn't think anything of it, because I was pretty sure they couldn't do anything until they informed me in writing first. I never got a letter, but the collection account showed up on TU and Equifax. I disputed both it came off on TU, but remains on Equifax. This is my only negative on my Equifax report and my score is 620. Top 2 negative reasons for score is collection acount on file, and a relatively new collection account on file.
    Now I know I have them on some violations, but in the past my negatives were all with the OC and I don't really know where to start with this one. Any help will be appreciated.

    First violation is that they (the CA) never notified you. And that's all you need AND you need actual damages. Been denied credit lately, employment, etc.?

    I'd just go straight debt validation on the CA, find out where to send them letters, and just go for it. If they won't cooperate, then sue them.

    That's a good reason NEVER to deal with these jokers on the phone.

    1- No written notice - violation

    2 - Implying that it would go to Legal is a violation, if they don't intend to do it. (too bad that's not in writing)

    3- Asking for payment to send written notification?!?!?!? How stupid are these monkeyboys???

    Send a validation letter and tell them You're sending it to "legal". I wouldn't even give them 30 days, I'd give them 10 business days. I'd also send something to the OC stating, "Why the Hell didn't you notify me that you weren't able to withdraw payments??? Look what you've done now - you may be liable".

    Who's the CA? I gotta find out more about these dipweeds.

    It's a local collection agency here in Sacramento called States Recovery System Inc.
    I was pretty surprised when I was talking to the lady, and I honesty thought that they couldn't do anything. The reson I'm disputing the debt is because with the Health Club membership you sign up for a 2- year contract. Then if you don't pay for a month they suspend your membership until you catch up on payments. I'm disputing because they never informed me that I was missing payments-- I didn't find out till I tried to go to the gym a couple of months later, and I disagree with them being able to charge me for the months when they refused to grant me the service (which would mean that I owe only one or two montly payments since they suspend the membership once you miss one or two). Another thing is how they are afraid of people calling and cancelling so they don't have a phone-number on the card or anywhere easily accessible.
