I have been going round and round for months now with this one CA.
First contact was thru summons served upon me at my home. I called them and offered a settlement (pre-creditnet board), to which they refused.
I started searching online and came across this board in the process.
I sent a validation letter, CRRR, to which the first two were ignored. In that meantime, I disupted with the CRA and it came back verfied.
I went to court, 1st time and was reset for a few months later.
Called an attorney, who says that he saw the first contact letter, but it is unsigned....this tells me, I can go into WORD and reprint and letter and change the date too. Attonery does not want to take this case on. During this time, had 2nd court date, that was again reset for several months later.
Again, disputed with CRA's to which it again came back verified and a greater amount being owed, but all the other information stayed the same...even last updated or reported date.
So as one last attempt, I disupted with the CRA's again and now it is gone.
I still have a court date pending in two months, but not sure how to proceed.
Attorney suggested I just settle and be done with it. Should I do that now? offer an amount, settle with wording that they cannot post this to the CRA's, or try to nail them for violations?
My violations, if I am correct are:
No first notice, except summons, which did not include mini-miranda. They claim they sent a notice, I did not recieve, so who has upper hand?
Verifying with the CRA, without validation.
Calling me and offering a settlement amount, without validation? Got proof of that.
Failure to mark as in dispute, after I disputed.
Have several credit reports printed as proof as well.

    I need some input please.

They now want $2500.00, without talking to them for settlement

Looks like you have at least 3 violations at 1000 Ea. for a total of $3000.
Sue them and make them eat the debt.
