I sent this letter through planetfeedback last night. To: Chrysler Financial Corp. I hope you are able to help me with a problem I've encountered with Chrysler Financial Corp.. The problem concerns the account management at your bank. . "account information can be pulled by Chrysler Financial through my name, address and contract date of Jan/2003" Purchased a 2003 4x4 Durango SLT Plus in January of 2003 for roughly $36,000. My credit reports with all three bureaus have not been updated since the opening of this account in January of 2003. I will not drag on about the negative aspects this is having on my FICO score as I am sure you well understand. I however am in the process of purchasing a second home and this account is causing me massive headaches with potential lenders. I wrote to you in March of this year regarding this being over looked via your websites customer service email/form. I got a response saying it was being sent for "account review". Well in May of 2003, I check the report again having given Chrysler Financial plenty of time to update my reports. Yet again I was shocked to be staring at my report with a Chrysler Financial tradeline on my report with the heading "to new to rate". I then call, and the person I spoke to was very sweet and understanding and said she would get it handled the next time Chrysler Financial updates the credit bureaus. So I pull my report July 15,2003 and it has still not been updated. I then write yet another email to your company through your site on July 16 of 2003. Today July 17, I get another automated response "submitted for account review". I have now turned to planetfeedback for help. While it is not the law to report anything to the credit bureaus it is federal law if reporting information to credit bureaus to report accurate up to date information. I have saved/made copies of all of my correspondence with Chrysler Financial, saved all emails, and copies of my credit report to have proof of your willful non-compliance of federal law. I am not wanting my Chrysler Financial tradeline deleted from my reports as that would only show your companies spiteful side. Which only would result in me taking swift legal action against your company for past and current FCRA violations, that coupled with being able to show the courts I have suffered emotionally and financially as your inaccurate reporting to the credit bureaus has resulted in me not being offered the lowest rates of interest on the current loan I am seeking. I also have statements from several lenders saying how Chrysler Financial's tradeline on my credit reports is the "ONLY" factor preventing me from getting a better rate. One lender even took the time to call Chrysler Financial to get a fax or e-mail of my payment history as she would not accept the one I printed from your company website. She was assured by Chrysler Financial's customer service it would be handled within 48 hours. Well nothing ever showed up. This instance is also documented in saved correspondence from this potential lender. This is my last attempt asking Chrysler Financial to take a minute and submit the UDF "universal data form" to the credit bureaus to update my payment history as by federal law your suppose to do before I hand this issue over to counsel. I have all the proof I need and will be able to show I have tried on several occasions to correct this issue before taking it before a federal judge which if this is not corrected I will be forced to do. I have had my attorney look over all documents I signed when purchasing my 36k truck from Thomas Dodge and they have informed me I never signed a waiver of legal action against Chrysler Financial opting for mediation instead. This has delayed the purchase of my vacation home and has stolen time away from me, I could have spent with my new wife and my step-children enjoying a vacation home during their summer break from school. In the future I plan to take my business to other banks, and I'll urge others to avoid banking with you. Here's the resolution I propose: I would like Chrysler Financial to do no more than what they are and were suppose to be doing all this time. Update my credit files with all three (Transunion, Equifax, and Experian) credit bureaus before Chrysler Financial forces my hand in taking legal action. Thank you for your consideration in this matter. I look forward to your prompt reply. From: GEARHEAD il Today.. My experian report is reporting like this.. This was changed mid-day. Thoughts , Ideas Comments???? before the obvious is stated, I know it was not the most articulate planetfeedback letter.. But I am at my wits end with this.. It is utterly insane..
Have you tried disputing thru the CRAs as something like incorrect balance? I have personally found that this is sometimes the easiest way to get the OC to update.
No, as I have found out in the past. When I have disputed a positive trade-line. EXP will just delete it and TU an Equifax will just mark verified. I don't want the line deleted, I want it to be accurate.
Good PFB letter! Obviously, this is just the start -- if they don't play ball, there are several different ways to go. It will be interesting to see how they respond to this first volley. Doc
My Equifax and my TU reports have all been updated as of this morning. Now my Experian report is the only one that is still saying what I reported above.. More than likely I will have to deal with EXP on that one.. SHOCKER.. lol It is still in the Positive accounts, but it is highlighted blue as in dispute. Perhaps they just haven't updated like Equifax and TU have. Perhaps Monday it will be fixed. In any event, as long as I got it showing on one of them I am happy. Just is a sad fact, I had to go to these extremes over such a minor thing of reporting a payment history. I did leave another PFB letter.. updating the situation. Might as well put it up so perhaps someone could see the route I had to take to get any type of response from them.
