Aurora Loan has been reporting us as 120+ days delinquent on a mortgage that had been discharged in a Chap. 7 April 2003. The "delinquencies" stem from payments that would have been reaffirmed IF we had done so, which we didn't. The debt was included in the discharge. It dropped our FICO scores by about 70. Today we get a letter from Aurora with a request to authorize them to distribute funds from some unknown escrow account in order to pay back taxes. First off, this escrow is their own money. We haven't sent them a payment since filing for BK in 1/03. Second, they tried to sell the house at a sheriff's sale on 4/1 with no takers except their rep, who bid on it so Aurora could get the title. I have had it up to here with these idiots. They are listed on the Schedule F included with the discharge paper, yet have consistently acted as though nothing has happened. Can someone please help me handle this situation once and for all. I want to sue them good for their underhanded methods (they sabotaged 2 short sales of the house so they could have their own sale/foreclosure, as well as not even informing the first mortgage holder what they did). There are other strange actions as well. Do we really need a lawyer to sue? We can't afford one. I need to spend hundreds on my monthly medications and we can't even replace a broken air conditoner at this point and are sweltering in the heat. I consider every letter from Aurora re: taxes, insurance, escrow etc. on this house as undue harassement and violations of the BK discharge. Let alone that awful notation on our credit. This is gone beyond a simple "Will you please get your act together" type of situation. A google search on Aurora Loan Complaints produces some interesting results so I'm not alone in having major problems with this company. I was thinking about complaining to the FTC. Wonder if they would respond? Thanks in advance, as always.
My BK lawyer is worth s***. Unfortunately we picked a real dud. He got us through the BK alright but that's all he knows. He has as much admitted this to us. Knows nothing about foreclosures, credit reporting etc., and "I really don't know any attorney who can help you." He will no longer return phone calls. I tried to get another BK lawyer to help but as is usually the case, he/she doesn't want to "fix other lawyer's mistakes or take on cases they should be handling." So you see it is pretty hard for us to get the legal advice we need. If I contact the Court, they will probably refer us back to this dud. However, someone suggested we try to find a lawyer who does both BK and Real Estate and, if we are lucky enough, consumer reporting/fraud as well. It's just the money, we really need so many things and a lot of lawyers, unless they see $$$ in it for themselves, don't want to bother. You can understand why we are so frustrated. I know from other internet sites that there are people who sue on their own, but are rarely taken seriously, don't know the proper forms, procedures etc. This is where we wish we had a lawyer in the family! Tomorrow I'm going to the Court House to look at the paperwork regarding this property. It was foreclosed on 4/1 yet we haven't heard a thing and keep getting letters from the lender as if nothing ever happened. Once I see what is recorded, I'll post how the record reads. This will probably provide more fuel for the fire and maybe get an attorney to take us seriously. Losing your home of 15 years was bad enough, but to lose it to 2 predatory lenders is heartbreaking.
