Hi, I was an old member here years ago and need some advice and help! I have a satisfied judgement showing on 2 of 3 CA's (EXperian and TU). I had tried in past to remove and not successful. What is the best path to follow here. How bad does it look on credit...for new credit cards and future for a home mortgage? Any help would be greatly appreciated..with specifics! Thanks Kevin
Kevin, you can get the judgment vacated -- that is the best way to get it removed. you would need a reason for it to be vacated. go to the court where it was filed and file to vacate the judgment. then you would appear in court and plead your case. were you properly summonsed? tboy
No way was I alerted. Lived home with parents at the time and sure know dad would have kicked my *** if he got wind of it. You know how I found out about this? My bank locked my checking account and when I went to ATM I could not get any cash! So I called bank, and they told me that they had been shown the judgement and to lock down my account. Sheesh what if I needed cash! Are they allowed to do this?Of course a week later i get a bank letter explaining all this. You think I can go a week with my checking account locked down? Anyways, so I found the local attorney, paid and left. My account was unlocked. $75 bank fee charged to me to do this. Nice huh? I don't think this counts as being served do you? Where exactly do I go..local county obviously but what office? I read some posts and seems like I need to get a copy of some documents but not sure exactly what. And then where would I file...small claims court? Kind of confused. If anyone woudl take a minute and step me through this I would greatly appreciate it. kevin
It's actually pretty easy to get the info. Review your credit report and see who is reporting the judgement. If you we served properly, then it would likely be your county or district courthouse. If you were not served properly, then it may be some OTHER courthouse [ maybe if you had a college address or something ]. The CR will also have a docket number. Call up clerk at the reporting courthouse. Ask the clerk to look up the docket, verify the info + status. Ask what you need to do to get a copy the judgement.
