need to hire a credit repair lawyer

    Looking to hire a credit repair lawyer possibly to fix this one huge issue.

    Seems like my girlfriend had a judgement entered against her in 1992. She was never served. The only info we have is a letter from this mitchell kay which is an income execution along with a note from sherrif to take 10% of pay. How do we prove that she was never served? She never had a chance to dispute this and she only found out about this 11 years later! Now they want to charge her back interest! How unfair! Is this even legal? I mean she didnt disappear as she lived in same area for all those years!

    Funny thing is this judgement doesnot show on any of the 3 credit reports!

    HELP!

    Do we need a lawyer?

    spoke to a lawyer who wanted $750 to try and negotiate this judgement down...to push the right buttons and get it down. He thinks he can get it down to a little above principal but with his fee it is close to original with interest.

    This is really a bad situation. Anyone have ideas. We have been served with the income execution and they took out one on her old job and will do again on current job.

    Also it is not on any cr and want to keep it this way.

    1) what is this debt for?
    2) what is the statute of limitations on judgments and if it is past that did they renew?
    3) what is the amount?
    4) you keep saying "they" - they who?

    Hi,

    Debt is from a old credit card.

    Debt is from late 1987 and judgement entered in 1992. no contact in 11 years.

    The original amount was 3300. Now they want 7000 due to interest.

    'They' is the law firm mitchell kay of New York who i guess assumed the debt from the original credito..something called first national bank of chicago who issued the cc.

    The sherrif here already debited 10% of her pay but she switched jobs. They sent another notice and want fulll $7000 no settlement. I was like forget it let them take $60 a week for years.

    But i mean where are my rights to verify the original judgement ? SHe was never served... so can we try to vacate this ourselves? Lawyer wants $1500 to come to court and then per hour. I cannot afford this.


    Any advice would be appreciated

    You don't need to hire this lawyer for anything. It sounds like he's standing in line trying to get your money.

    Some states allow you to be served through the mail. However, you may have been improperly served (especially since you weren't served at all). I think you should file a motion to vacate this judgement in whatever court awarded this judgement. File on the basis you were improperly served. It will take some work, but you can save the money the lawyer is trying to soak you for.
