Hello people again. I'm really needing some inspirational support. I want to know if anyone out there has took these non validating complying jacka_ _'s to court and what was their experience like. How receptive was the local court or wherever you had to go? I am validating now and I'm sure it's not going to go smooth!!!!!! Please share anything on this you can!! Thanks again..

    Hi John

I personally have not sued for failure to validate, but I have sued a CRA for failure to delete or correct.

Have you disputed with the CRA? If you don't owe it, you can also consider going after them for reporting it

Thanks kickman for the information. I'm just in my first stage of debt validation. It hasn't been but a day since I sent out my first validation letters (certified). I will keep everyone posted how things are going so maybe someone can learn from my mistakes and triumphs. THANKS please keep on responding anyone and everyone......

Not validating is not a violation. Its continuing collection activity after receiving a request for validation and not responding that is the violation.

    (State laws may differ though).

    Jlyn,

I have a CA that has not validated or attempted to contact me, however when I disputed the items with the CRA they sent the letter to the CA and the CA verrified the info. Isn't this considered a attempt to collect and is this enough to sue them? They have 4 listings on my report and I want them gone.

    Thanks
