Negotiating with CA not yet on CR.

    Just as I'm 90% done with cleaning up my credit, I get a letter from a CA on behalf of taxes I owe to a state Dept of Revenue. Couple hundred bucks I forgot about after I moved out of state.

    Just pulled all 3 reports, and they've reported nothing. Nor has the Dept of Rev.

    Also, I'm about a week over their initial 30-day deadline due to mail-forwarding issues.

    Want to pay it off in full. What's the best course of action, to make sure the CA and the Dept of Rev never report this to the bureaus? Ask them to draft a letter that they will never report this item if I pay in full?

    I've owed state & fed for the past 2 years & fell behind in payments- they never repoted to the CRA's- I beleive that they would get a judgement, which would be reported.

    It seems that some States use licenced collectors (even if the state doesn't normally require a lisence) for taxes & child support

    It's probably an ASSIGNED collection- I don't think gov'ts 'charge off' your tax debt & sell it to a CA

    Call your State Dept of Revenue, Explain your situation (& that you want to pay in full) & see if you can get the State to take the account back from the collector.

    They would rather have all of the money intead of losing a percentage to the collector

    Good advice... but could that piss the CA off and cause them to report something?

    Already traded calls with the CA rep.

    Shouldn't piss them off-

    If the State reclaims the account the CA has no claim to the debt or right to post anything to the CRAs- it's no longer belongs to the CA

    when you talk to the fine folks at the Dept of Revenue, just ask if they assigned it or sold it...

    If it's assigned they are acting for the State- the State has to tell them to sue, etc....

    In Georgia (my State) an the OC is legally responsible for the assigned collectors actions - so they usually play nice

    As it happens, it *is* the GA Dept of Rev. Don't live there anymore though.

    send the CA a Validation letter. If the CA does not supply proper validation and puts anything on your CR you will be able to sue for FDCPA violations - continued collection activity without proper validation
