New and I have a ? about bk13

    First of all we filed 11/1999. It was joint and we are paying $18K back. We were in arrears 2 months on our mortgage which was put into the bk (just the 2 months) we have been 30 days late a couple of times since them but to the bank it was always at least 90 days late because of the arrears in the bk.

    Anyway, my CR shows that it is an individual bk and the amount is $95K (I am assuming they included the total we owed on the whole mortgage and not just the arrears). My question is, Is this how this is done? We never filed 95K in bankruptcy. Also, the CR shows DOLA as 11/99 when in fact we have been paying our mortgage every month. So what exactly is going on?

    I'm just starting the credit repair process because we are planning on building a house in a couple of years when the BK is discharged.

    Definitely need to address this issue with your mortgage lender, call up and ask for their reporting department.

    Explain what your credit report says and what your situation is, let them know you want them to update your credit report correctly.

    I am not totally sure on this, (2 moths included in BK is something I had not seen done before).

    But they should have not dropped the reporting as they have obviouly done here, you will need the correct balance updated, not sure they may just be able to continue showing the delinquency - this is a hard one.

    If you are doing better at this time, you might explore the option of adding them two payments back onto the loan at the end to negotiate them updating as current. Just a thought.

    But definitley contact them to explore the options and what remedies you can come to terms together on.

    The arrears are paid up and it shows us as current but what I don't understand is that if it is in bankruptcy how they report it on the CR as being 90 days late?

    They (same bank as mortgage company) did the same thing with the auto loan. It was included in the BK (which was filed 1999) and it shows on the CR as 90 days 6 times in 2000. This loan is paid off, we have already received the title and have sold the darn thing.

    Should I go ahead and dispute the auto loan on the CRs as not mine?

    That there is a 50/50 thing, if you can make it reflect paid, as agreed as it was in the end, it might be worth saving - and doing your dispute directly with the creditor instead of the CRAs.

    See if you can save this and possibly make it positive again, if you can't you can always go back later to bump it off through spam disputes.

    I hate to keep bothering everyone but this really has me confused. I pulled Experian CR. The mortgage says Discharged through Chapt 13 and it continues on record until 11/2006. We are still paying the mortgage. Should I just wait until the BK is discharged to do anything or do something about it now? On account history it also says debt included in Chapter 13 Bankruptcy 11/05/2002. (Our BK was in 1999)
