Hi, I new and and in need of guidence. I was stupid and got married at 17. the idiot i married used my name and credit and i diddnt know what i was doining now that im divorced i cant get out from under this nightmare. He had a personall line of credit that he put my name on for $15,000. I never as far as i know signed anything. But there coming after me for the money what do i do?
What you're suggesting is that he applied for credit in your name without your knowledge; which (I think) is a felony. On the other hand, if you enjoyed the benefits of that credit while you were married, and now want to distance yourself from him AND those goodies, then I can see how the creditor is coming after you too. If you really didn't know that he opened these accounts in your name, and you had no reason to suspect that he had, then you need to get in touch with your local law enforcement who handles identity theft. In all honesty though, it's going to be tough to prove that you didn't know anything about it.
And different states have different laws. In some states. if the debt was incurred while you were married, it belongs to both of you whether you signed anything or not. I'd try to get a free initial consultation with an attorney who is familiar with the credit laws in your state.
