New account showing on DHs report. It is from A-1 Collections for Yampa Valley Medical, 10/1999, $139.00. This took some thinking on our part to remember. We were on vacation in CO and he scratched his cornea. We went to the ER. We had insurance and we filled out forms. Our insurance should have paid 100% of an ER visit. That was the last we heard of it. We have not received any letters or phone calls from either place. It just appeared this week on his CR. We moved shortly after the hospital visit, but our phone number stayed the same. What should we do?
After your move the Hospital FAILED to properly process the change of address you sent to them immediately, by mail. Therefore they are in violation of the FCBA.
I didn't send a Change of Address to the hospital, it didn't even occur to me. This bill happened in the fall of 1999 and we moved during the summer of 2000. We did fill out a forwarding packet at the PO, which would have forwarded anything for 6 months. How do I prove that I never received anything from them? I called my old insurance company (I switched jobs at the end of 2000) and they said that they sent an accident report to me at our old address. She said it wasn't returned so they closed the case. She said that they can reopen it if I fill out the accident report (and state that there was no accident) and they will cover it 100%. What should I do about the collection agency? I can't actually prove I didn't receive anything.
Re: Re: New CA Account I can't actually prove I didn't receive anything. golf67 Then let them prove you did.
Re: Re: New CA Account Should I contact the CA and make an offer for payment for deletion? I don't think they will be in a hurry to get a hold of us, because it isn't much money. If I call them, am I in a sense admitting that it is mine? I'm not trying to get out of paying something that we owe, but we want deletion.
Re: Re: New CA Account Perhaps you can try speaking with the hospital and explaining the situation? Most ER admissions indicate the cause of injury and if the injury was reported not to be the result of an accident then I would think this would have already been provided to the insurance company by the hospital. Sounds like the insurance company failed to process the claim and instead closed it out and came up with a lame excuse. The hospital may take the account back if you tell them the insurance company has agreed to process the claim and pay it in full. This will get the CA out of the picture and you deal directly with the hospital and ins co. If the hospital takes back the account insist on immediate deletion of the collection agency record from your CR. Don't pay the CA a dime. Don't negotiate or even speak to the CA.
Re: Re: Re: New CA Account If you just want to settle this and make it go away why not put in your letter something along the lines of "I do not believe this is my debt, however because of the small amount, I would be willing to pay the full balance in exchange for deletion of the TL". Just my .02
Re: Re: Re: New CA Account I just had a similar problem with my ins co not paying a claim. After two months of calling and faxing, they finally (over)paid the endo's office. My suggestion would be to go back to your insurance company and find out what their reasoning was when they denied the claim. Force them to review it again and get it paid. The endo's office we were dealing with agreed to a deletion of the CA tl once they rec'd payment from the ins. co.
